AMENDMENT TO HOUSE RESOLUTION 33

2     AMENDMENT NO. ___. Amend House Resolution 33 by replacing
3 everything after the title with the following:
 
4     "WHEREAS, The Department of Healthcare and Family Services
5 ("Department") administers the medical assistance ("Medicaid")
6 program under the Illinois Public Aid Code; and
 
7     WHEREAS, The Medicaid program provides coverage of nursing
8 home and other healthcare expenses for low-income persons; and
 
9     WHEREAS, Under the Illinois Public Aid Code, the Department
10 has the authority, in certain circumstances, to file claims
11 against the estates of deceased Medicaid recipients for amounts
12 expended on a recipient's behalf under the Medicaid program;
13 and
 
14     WHEREAS, If the deceased recipient was a nursing home

1 resident for a substantial period of time or receiving medical
2 services for a substantial period of time, a claim may amount
3 to many thousands of dollars, which can be quite a shock to the
4 recipient's heirs, executor, and/or administrator; and
 
5     WHEREAS, Because of the passage of time, there may be no
6 way to verify the correctness of some items comprising the
7 claim and the Medicaid recipient, executor, or administrator
8 may have legitimate concerns about his or her liability for
9 approving such items; and
 
10     WHEREAS, The aforementioned circumstances and procedures
11 can create the possibility of error or misuse or abuse of the
12 system; therefore, be it
 
13     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
14 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
15 the Department of Healthcare and Family Services examine the
16 methods by which a recipient, or his or her designee, while
17 still living, can be provided with timely notice of each item
18 of goods or services provided to the recipient under the
19 medical assistance program, including in the notice at least
20 the following: (i) a description of the item; (ii) the date the
21 item was provided; (iii) the name and address of the vendor
22 providing the item; and (iv) the cost of the item; and be it
23 further

1     RESOLVED, That the Department of Healthcare and Family
2 Services report its findings and recommendations to the House
3 of Representatives; and be it further
 
4     RESOLVED, That copies of this resolution be delivered to
5 the Governor and the Director of Healthcare and Family
6 Services.".
