HOUSE RESOLUTION 33

 
2     WHEREAS, The Department of Healthcare and Family Services
3 ("Department") administers the medical assistance ("Medicaid")
4 program under the Illinois Public Aid Code; and
 
5     WHEREAS, The Medicaid program provides coverage of nursing
6 home and other healthcare expenses for low-income persons; and
 
7     WHEREAS, Under the Illinois Public Aid Code, the Department
8 has the authority, in certain circumstances, to file claims
9 against the estates of deceased Medicaid recipients for amounts
10 expended on a recipient's behalf under the Medicaid program;
11 and
 
12     WHEREAS, If the deceased recipient was a nursing home
13 resident for a substantial period of time or receiving medical
14 services for a substantial period of time, a claim may amount
15 to many thousands of dollars, which can be quite a shock to the
16 recipient's heirs, executor, and/or administrator; and
 
17     WHEREAS, Because of the passage of time, there may be no
18 way to verify the correctness of some items comprising the
19 claim and the Medicaid recipient, executor, or administrator
20 may have legitimate concerns about his or her liability for
21 approving such items; and

1     WHEREAS, The aforementioned circumstances and procedures
2 can create the possibility of error or misuse or abuse of the
3 system; therefore, be it
 
4     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
5 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
6 the Department of Healthcare and Family Services examine the
7 methods by which a recipient, or his or her designee, while
8 still living, can be provided with timely notice of each item
9 of goods or services provided to the recipient under the
10 medical assistance program, including in the notice at least
11 the following: (i) a description of the item; (ii) the date the
12 item was provided; (iii) the name and address of the vendor
13 providing the item; and (iv) the cost of the item; and be it
14 further
 
15     RESOLVED, That the Department of Healthcare and Family
16 Services report its findings and recommendations to the House
17 of Representatives; and be it further
 
18     RESOLVED, That copies of this resolution be delivered to
19 the Governor and the Director of Healthcare and Family
20 Services.
