AMENDMENT TO HOUSE BILL 3861

AMENDMENT NO. ______. Amend House Bill 3861 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Insurance Code is amended by adding Section 370u as follows:

(215 ILCS 5/370u new)

Sec. 370u. Non-contracted health care providers. A group or individual policy of accident and health insurance amended, delivered, issued, or renewed in this State after the effective date of this amendatory Act of the 96th General Assembly that provides incentives for insureds, enrollees, or beneficiaries to seek services from contracted providers must ensure that when an insured, enrollee, or beneficiary has received insurer approval to utilize a contracted provider for covered services and, due to a lack of reasonable and equitable access to contracted providers, the services are provided by a non-contracted provider, the covered service is provided at no greater cost to the insured, enrollee, or beneficiary than had the service been provided by a contracted provider.".
