AMENDMENT TO HOUSE BILL 3005

2     AMENDMENT NO. ______. Amend House Bill 3005 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Property Control Act is amended by
5 changing Section 7.3 as follows:
 
6     (30 ILCS 605/7.3)  (from Ch. 127, par. 133b10.3)
7     Sec. 7.3. The Administrator shall have charge of all
8 transferable property and shall have authority to take
9 possession and control of such property in order to transfer or
10 assign any such property to any other State agency that has
11 need or use for such property or to dispose of said property in
12 accordance with Section 7 of this Act.
13     Notwithstanding any other provision of law to the contrary,
14 each airplane and helicopter owned by the State and not
15 designated for emergency use under a plan developed pursuant to
16 Section 3.120 of the Emergency Medical Services (EMS) Systems

1 Act is deemed surplus and shall be sold by the Administrator as
2 soon as possible after the effective date of this amendatory
3 Act of the 96th General Assembly, using whatever method of
4 sale, including but not limited to a widely used global
5 Internet auction site, that the Administrator in his or her
6 discretion determines most profitable to the State. Each
7 airplane and helicopter owned by the State and designated for
8 emergency use under a plan developed pursuant to Section 3.120
9 of the Emergency Medical Services (EMS) Systems Act shall be
10 deemed surplus property and sold by the Administrator as soon
11 as possible after the airplane or helicopter ceases to be so
12 designated, using whatever method of sale, including but not
13 limited to a widely used global Internet auction site, that the
14 Administrator in his or her discretion determines most
15 profitable to the State. Proceeds from the sale of each
16 airplane or helicopter shall be deposited into the State Parks
17 Fund and used for State park improvements.
18     The Administrator may not dispose of a transferable
19 airplane by sale until he or she determines that (i) the agency
20 no longer has a need for the airplane, (ii) the airplane will
21 not be used as a trade-in on another aircraft, and (iii) no
22 public university or college in Illinois that offers courses in
23 aviation, flight training, or other subjects involving
24 knowledge of the workings of an airplane has listed the need
25 for an airplane as provided in this Section.
26     Responsible officers shall periodically report all

1 transferable property at locations under their jurisdictions
2 to the Administrator. The Administrator shall review such
3 reports and arrange for physical examination of said property
4 if necessary to determine if said items of transferable
5 property should be transferred to another State agency,
6 transferred to a central warehouse, or disposed of. The
7 Administrator shall advise responsible officers of the results
8 of these reviews as necessary.
9     The staff under the jurisdiction of the Administrator shall
10 review as necessary State agencies' inventories for potential
11 items of transferable property. If in the opinion of the
12 Administrator's staff, any property appears to be
13 transferable, the Administrator shall notify the responsible
14 officer of his determination. The executive head of the agency
15 holding the property in question may appeal the determination
16 in writing to the Administrator.
17     The Administrator will review the determination in
18 accordance with rules and procedures established pursuant to
19 Section 5 of this Act.
20     The Administrator shall maintain lists of transferable
21 property and of State agency needs for such property and will
22 transfer where appropriate listed transferable property to
23 agencies listing their needs for such property as detailed by
24 their responsible officers. The Administrator must give
25 priority for transfer of an airplane, that is not to be used as
26 a trade-in, to a public university or college in Illinois that

1 offers courses in aviation, flight training, or other subjects
2 involving knowledge of the workings of an airplane and that has
3 listed the need for an airplane.

5     Section 99. Effective date. This Act takes effect upon
6 becoming law.".
