AMENDMENT TO HOUSE BILL 1146

2     AMENDMENT NO. ______. Amend House Bill 1146 on page 2, line
3 15, by inserting "(DOL)" before the colon; and
 
4 on page 3, by replacing lines 3 and 4 with the following:
5 "employees, and the anti-discrimination notice issued by the
6 Illinois Department of Human Rights (IDHR)."; and
 
7 on page 3, line 6, by replacing "Department" with "DOL"; and
 
8 on page 3, line 8, by replacing "Department" with "DOL"; and
 
9 on page 3, by replacing line 15 with "supplied by DHS, OSC, and
10 IDHR in a prominent place"; and
 
11 on page 3, by inserting immediately below line 24 the
12 following:
13     "(2.5) to fail to take reasonable steps to prevent an

1 employee from circumventing the CBT by assuming another
2 employee's Basic Pilot or E-Verify user identification or
3 password;"; and
 
4 on page 5, line 9, by changing "Act." to "Act;"; and
 
5 on page 5, by inserting immediately below line 9 the following:
6         "(4) to screen job applicants prior to date of hire;
7         (5) to terminate or take other adverse action prior to
8     a final nonconfirmation finding from the relevant federal
9     government agency;
10         (6) to fail to notify an employee, in writing, of a
11     tentative nonconfirmation notice from the federal
12     government, the employee's right to contest the notice, and
13     the contact information for the relevant government agency
14     where such a contest should be taken up and resolved; or
15         (7) to discourage an employee with a tentative
16     nonconfirmation notice from contesting the tentative
17     nonconfirmation notice.
18     (c-5) It is a violation of this Section for an individual
19 to falsely pose as an employer and enroll in an Employment
20 Eligibility Verification System."; and
 
21 on page 5, by replacing lines 10 through 20 with the following:
22     "(d) Preemption. No unit of local government, including a
23 home rule unit, may require any employer to use an Employment

1 Eligibility Verification System, including under the following
2 circumstances:
3         (1) as a condition of receiving a government contract;
4         (2) as a condition of receiving a business license; or
5         (3) as penalty for violating licensing or other similar
6     laws.
7     This subsection (d) is a denial and limitation of home rule
8 powers and functions under subsection (h) of Section 6 of
9 Article VII of the Illinois Constitution.".
