SYNOPSIS AS INTRODUCED:
 
70 ILCS 705/11f   from Ch. 127 1/2, par. 31f

    Amends the Fire Protection District Act. Provides that, until January 1, 2010, the fee charged to persons and entities that are not residents of the fire protection district for the cost of providing services shall not exceed $250 per vehicle (now, $125) and shall not exceed $70 per hour per firefighter (now, $35 per hour per firefighter). Provides that those amounts shall be adjusted annually to reflect changes in the Consumer Price Index during the previous 12-month period. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Fire Protection District Act is amended by
5 changing Section 11f as follows:
 
6     (70 ILCS 705/11f)  (from Ch. 127 1/2, par. 31f)
7     Sec. 11f. Charge against non-residents.
8     (a) The board of trustees of a fire protection district may
9 fix, charge, and collect fees not exceeding the reasonable cost
10 of the service for all services rendered by the district
11 against persons, businesses and other entities who are not
12 residents of the fire protection district.
13     (b) Such charge may not be assessed against residents of
14 the fire protection district or persons who request fire
15 protection coverage for an unprotected area and who pay to the
16 fire protection district an amount equal to the district's Fire
17 Protection Tax pursuant to Section 4 of the Fire Protection of
18 Unprotected Area Act.
19     (c) Until January 1, 2010, the The charge for such services
20 shall be computed at a rate not to exceed $250 $125 per hour
21 per vehicle and not to exceed $70 $35 per hour per firefighter
22 responding to a call for assistance. Beginning January 1, 2010,
23 those amounts shall be adjusted annually to reflect changes in

1 consumer price index-u during the previous 12-month period. An
2 additional charge may be levied to reimburse the district for
3 extraordinary expenses of materials used in rendering such
4 services. No charge shall be made for services for which the
5 total charge would be less than $50.
6     (d) All revenue from the charges assessed pursuant to this
7 Section shall be deposited to the general fund of the fire
8 protection district.
9     (e) In this Section, "consumer price index-u" means the
10 index published by the Bureau of Labor Statistics of the United
11 States Department of Labor that measures the average change in
12 prices of goods and services purchased by all urban consumers,
13 United States city average, all items, 1982-84 = 100.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
