SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.4d new

    Amends the Illinois Public Aid Code. Provides that on or after July 1, 2009, the Department of Healthcare and Family Services shall ensure that each facility licensed by the Department of Public Health under the Nursing Home Care Act as a skilled nursing facility or intermediate care facility, except those licensed for the express purpose of serving residents who are developmentally disabled or as long term care facilities for residents under 22 years of age, receives the next regular payment due for services provided by the facility to medical assistance recipients no later than 35 days after the effective date of the amendatory Act. Provides that every subsequent payment to such a facility must be made no later than 35 days after the date of the last preceding payment. Effective immediately.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5.4d as follows:
 
6     (305 ILCS 5/5-5.4d new)
7     Sec. 5-5.4d. Facilities for persons other than
8 developmentally disabled or under age 22; time of payments. On
9 or after July 1, 2009, the Department of Healthcare and Family
10 Services shall ensure that each facility licensed by the
11 Department of Public Health under the Nursing Home Care Act as
12 a skilled nursing facility or intermediate care facility,
13 except those licensed for the express purpose of serving
14 residents who are developmentally disabled or as long term care
15 facilities for residents under 22 years of age, receives the
16 next regular payment due for services provided by the facility
17 to medical assistance recipients under this Article no later
18 than 35 days after the effective date of this amendatory Act of
19 the 96th General Assembly. Every subsequent payment to such a
20 facility under this Article must be made no later than 35 days
21 after the date of the last preceding payment under this

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
