AMENDMENT TO SENATE BILL 1529

2     AMENDMENT NO. ______. Amend Senate Bill 1529 on page 2, by
3 replacing lines 21 through 26 with the following:
4 "under the contract. The failure of the public body awarding
5 the contract to insert the prevailing wage stipulation in the
6 project specifications or the contract does not excuse a
7 contractor or subcontractor from paying, and is not a defense
8 to an action brought because of the failure of a contractor or
9 subcontractor to pay, the prevailing wage to all laborers,
10 workers, and mechanics performing work under a contract or
11 subcontract covered by this Act."; and
 
12 on page 3, by replacing lines 14 through 18 with the following:
13 "in violation of this Act. The failure to provide the required
14 stipulations does not excuse the contractor, subcontractor, or
15 any lower tiered subcontractor from paying, and is not a
16 defense to an action brought because of the failure of a
17 contractor, subcontractor, or lower tiered subcontractor to

1 pay, the prevailing wage to all laborers, workers, and
2 mechanics performing work under a contract or subcontract
3 covered by this Act."; and
 
4 on page 4, by replacing lines 4 through 9 with the following:
5 "the revised rate. The failure of the public body to notify the
6 contractor and each subcontractor of the revised rate does not
7 excuse contractors and subcontractors from their obligations,
8 and is not a defense to an action brought because of the
9 failure of a contractor or subcontractor to perform its
10 obligations, under this Act, including the requirement to pay
11 the revised rate to all laborers, workers, and mechanics
12 performing work under a contract or subcontract covered by this
13 Act.".
