AMENDMENT TO SENATE BILL 1529

AMENDMENT NO. ______. Amend Senate Bill 1529 on page 2, by replacing lines 21 through 26 with the following:

"under the contract. The failure of the public body awarding the contract to insert the prevailing wage stipulation in the project specifications or the contract does not excuse a contractor or subcontractor from paying, and is not a defense to an action brought because of the failure of a contractor or subcontractor to pay, the prevailing wage to all laborers, workers, and mechanics performing work under a contract or subcontract covered by this Act."; and

on page 3, by replacing lines 14 through 18 with the following:

"in violation of this Act. The failure to provide the required stipulations does not excuse the contractor, subcontractor, or any lower tiered subcontractor from paying, and is not a defense to an action brought because of the failure of a contractor, subcontractor, or lower tiered subcontractor to pay, the prevailing wage to all laborers, workers, and mechanics performing work under a contract or subcontract covered by this Act."; and

on page 4, by replacing lines 4 through 9 with the following:

"the revised rate. The failure of the public body to notify the contractor and each subcontractor of the revised rate does not excuse contractors and subcontractors from their obligations, and is not a defense to an action brought because of the failure of a contractor or subcontractor to perform its obligations, under this Act, including the requirement to pay the revised rate to all laborers, workers, and mechanics performing work under a contract or subcontract covered by this Act.".
