AMENDMENT TO SENATE BILL 769

2     AMENDMENT NO. ______. Amend Senate Bill 769 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Police Act is amended by changing
5 Section 9 as follows:
 
6     (20 ILCS 2610/9)  (from Ch. 121, par. 307.9)
7     Sec. 9. Appointment; qualifications.
8     (a) Except as otherwise provided in this Section, the
9 appointment of Department of State Police officers shall be
10 made from those applicants who have been certified by the Board
11 as being qualified for appointment. All persons so appointed
12 shall, at the time of their appointment, be not less than 21
13 years of age, or 20 years of age and have successfully
14 completed 2 years of law enforcement studies at an accredited
15 college or university. Any person appointed subsequent to
16 successful completion of 2 years of such law enforcement

1 studies shall not have power of arrest, nor shall he be
2 permitted to carry firearms, until he reaches 21 years of age.
3 In addition, all persons so certified for appointment shall be
4 of sound mind and body, be of good moral character, be citizens
5 of the United States, have no criminal records, possess such
6 prerequisites of training, education and experience as the
7 Board may from time to time prescribe, and shall be required to
8 pass successfully such mental and physical tests and
9 examinations as may be prescribed by the Board. All persons who
10 have been honorably discharged and who have been awarded an
11 Afghan or Iraqi campaign medal after September 11, 2001 by the
12 military or naval services of the United States are deemed to
13 have met the collegiate educational requirements,
14 notwithstanding any Board rule. Preference shall be given in
15 such appointments to persons who have honorably served in the
16 military or naval services of the United States. All appointees
17 shall serve a probationary period of 12 months from the date of
18 appointment and during that period may be discharged at the
19 will of the Director. However, the Director may in his or her
20 sole discretion extend the probationary period of an officer up
21 to an additional 6 months when to do so is deemed in the best
22 interest of the Department.
23     (b) Notwithstanding the other provisions of this Act, after
24 July 1, 1977 and before July 1, 1980, the Director of State
25 Police may appoint and promote not more than 20 persons having
26 special qualifications as special agents as he deems necessary

1 to carry out the Department's objectives. Any such appointment
2 or promotion shall be ratified by the Board.
3     (c) During the 90 days following the effective date of this
4 amendatory Act of 1995, the Director of State Police may
5 appoint up to 25 persons as State Police officers. These
6 appointments shall be made in accordance with the requirements
7 of this subsection (c) and any additional criteria that may be
8 established by the Director, but are not subject to any other
9 requirements of this Act. The Director may specify the initial
10 rank for each person appointed under this subsection.
11     All appointments under this subsection (c) shall be made
12 from personnel certified by the Board. A person certified by
13 the Board and appointed by the Director under this subsection
14 must have been employed by the Illinois Commerce Commission on
15 November 30, 1994 in a job title subject to the Personnel Code
16 and in a position for which the person was eligible to earn
17 "eligible creditable service" as a "noncovered employee", as
18 those terms are defined in Article 14 of the Illinois Pension
19 Code.
20     Persons appointed under this subsection (c) shall
21 thereafter be subject to the same requirements and procedures
22 as other State police officers. A person appointed under this
23 subsection must serve a probationary period of 12 months from
24 the date of appointment, during which he or she may be
25 discharged at the will of the Director.
26     This subsection (c) does not affect or limit the Director's

1 authority to appoint other State Police officers under
2 subsection (a) of this Section.

4     Section 99. Effective date. This Act takes effect upon
5 becoming law.".
