SYNOPSIS AS INTRODUCED:
 
New Act
815 ILCS 505/2Z   from Ch. 121 1/2, par. 262Z

    Creates the Internet Caller Identification Act. Provides that no person shall use any Internet caller identification equipment or Internet phone equipment in such a manner as to make a number or name, other than the caller's residential or business phone number or the caller's legal or business name, appear on a caller identification system of the recipient of the call. Provides that any person who knowingly uses or has knowingly used any Internet caller identification equipment or Internet phone equipment in violation of the Act commits an unlawful act or practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make a violation of the Internet Caller Identification Act a violation of the Act.

A BILL FOR

1     AN ACT concerning caller identification.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Internet Caller Identification Act.
 
6     Section 5. Definition. As used in this Act:
7     "Caller identification" means the display of the caller's
8 telephone number or identity to the recipient of the call.
 
9     Section 10. Internet caller identification. No person
10 shall use any Internet caller identification equipment or
11 Internet phone equipment in such a manner as to make a number
12 or name, other than the caller's residential or business phone
13 number or the caller's legal or business name, appear on a
14 caller identification system of the recipient of the call.
 
15     Section 15. Violations. Whenever any person knowingly uses
16 or has knowingly used any Internet caller identification
17 equipment or Internet phone equipment in violation of this Act,
18 that use shall be deemed an unlawful act or practice under the
19 Consumer Fraud and Deceptive Business Practices Act. In the
20 case of the use of Internet caller identification or Internet
21 phone equipment in violation of this Act, all remedies,

1 penalties, and authority available to the Attorney General and
2 the several State's Attorneys under the Consumer Fraud and
3 Deceptive Business Practices Act for the enforcement of that
4 Act shall be available for the enforcement of this Act.
 
5     Section 85. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by changing Section 2Z as follows:

8     Sec. 2Z. Violations of other Acts. Any person who knowingly
9 violates the Automotive Repair Act, the Automotive Collision
10 Repair Act, the Home Repair and Remodeling Act, the Dance
11 Studio Act, the Physical Fitness Services Act, the Hearing
12 Instrument Consumer Protection Act, the Illinois Union Label
13 Act, the Job Referral and Job Listing Services Consumer
14 Protection Act, the Travel Promotion Consumer Protection Act,
15 the Credit Services Organizations Act, the Automatic Telephone
16 Dialers Act, the Pay-Per-Call Services Consumer Protection
17 Act, the Telephone Solicitations Act, the Illinois Funeral or
18 Burial Funds Act, the Cemetery Care Act, the Safe and Hygienic
19 Bed Act, the Pre-Need Cemetery Sales Act, the High Risk Home
20 Loan Act, the Payday Loan Reform Act, the Mortgage Rescue Fraud
21 Act, subsection (a) or (b) of Section 3-10 of the Cigarette Tax
22 Act, the Payday Loan Reform Act, subsection (a) or (b) of
23 Section 3-10 of the Cigarette Use Tax Act, the Electronic Mail
24 Act, the Internet Caller Identification Act, paragraph (6) of

1 subsection (k) of Section 6-305 of the Illinois Vehicle Code,
2 Article 3 of the Residential Real Property Disclosure Act, the
3 Automatic Contract Renewal Act, or the Personal Information
4 Protection Act commits an unlawful practice within the meaning
5 of this Act.
