AMENDMENT TO SENATE BILL 266

2     AMENDMENT NO. ______. Amend Senate Bill 266 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by changing Sections
5 10-20.28 and 34-18.14 as follows:
 
6     (105 ILCS 5/10-20.28)  (from Ch. 122, par. 10-20.28)
7     Sec. 10-20.28. Cellular radio telecommunication devices.
8     (a) The General Assembly finds and declares that the
9 educational development of all persons to the limits of their
10 capacities is a fundamental goal of the people of this State
11 and that to achieve such goal it is essential to provide a safe
12 and secure learning environment within the public schools.
13 While recognizing that cellular radio telecommunication
14 devices may be used for inappropriate activities during school
15 hours and on school property and may, on occasion, cause
16 disruption to the classroom environment, the General Assembly

1 also recognizes that the use of cellular radio
2 telecommunication devices can decrease the response time of
3 officials to emergency situations. In addition, cellular radio
4 telecommunication devices allow parents an additional and
5 timely method of contacting their children should an emergency
6 situation arise. Therefore, it is the purpose and intention of
7 the General Assembly in enacting this legislation to (i) reduce
8 the occurrence of inappropriate and disruptive activities
9 during school hours and on school property occurring through
10 the use of cellular radio telecommunication devices and (ii)
11 increase the safety of students and school personnel during
12 school hours and on school property.
13     (b) The school board may establish appropriate rules and
14 disciplinary procedures governing the use or possession of
15 cellular radio telecommunication devices by a student while in
16 a school or on school property, during regular school hours, or
17 at any other time. However, a student must not be suspended or
18 given detention during regular school hours for violating any
19 rules or policies governing the use or possession of cellular
20 radio telecommunication devices.
