SYNOPSIS AS INTRODUCED:
 
625 ILCS 25/4   from Ch. 95 1/2, par. 1104

    Amends the Child Passenger Protection Act. Provides that any person transporting a child under the age of 8 years in any truck or truck tractor equipped with seat safety belts is responsible for securing the child in an appropriate child restraint system.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Child Passenger Protection Act is amended by
5 changing Section 4 as follows:
 
6     (625 ILCS 25/4)  (from Ch. 95 1/2, par. 1104)
7     Sec. 4. When any person is transporting a child in this
8 State under the age of 8 years in a non-commercial motor
9 vehicle of the first division, any truck or truck tractor that
10 is equipped with seat safety belts, any other a motor vehicle
11 of the second division with a gross vehicle weight rating of
12 9,000 pounds or less, or a recreational vehicle on the
13 roadways, streets or highways of this State, such person shall
14 be responsible for providing for the protection of such child
15 by properly securing him or her in an appropriate child
16 restraint system. The parent or legal guardian of a child under
17 the age of 8 years shall provide a child restraint system to
18 any person who transports his or her child. Any person who
19 transports the child of another shall not be in violation of
20 this Section unless a child restraint system was provided by
21 the parent or legal guardian but not used to transport the
22 child.
23     For purposes of this Section and Section 4b, "child

1 restraint system" means any device which meets the standards of
2 the United States Department of Transportation designed to
3 restrain, seat or position children, which also includes a
4 booster seat.
5     A child weighing more than 40 pounds may be transported in
6 the back seat of a motor vehicle while wearing only a lap belt
7 if the back seat of the motor vehicle is not equipped with a
8 combination lap and shoulder belt.
