SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.32 new

    Amends the Counties Code. Provides that, upon request by any person, the county recorder shall redact or remove certain personal information from any website maintained by the recorder or used by the recorder to display public records. Provides that any person who requests a redaction or removal without proper authority to do so is guilty of a petty offense. Requires each county recorder, within 12 months after the effective date of the amendatory Act, to submit a written policy to the General Assembly and the office of the Illinois Attorney General providing for the removal of all social security numbers from all records available from any website maintained by the recorder. Amends the State Mandates Act to require implementation without reimbursement by the State.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 3-5047 as follows:
 
6     (55 ILCS 5/3-5047 new)
7     Sec. 3-5047. Removal of personal information. Upon request
8 by any person, the recorder shall redact or remove that
9 person's social security number, employer taxpayer
10 identification number, drivers license number, State
11 identification number, passport number, checking account
12 number, savings account number, credit card number, debit card
13 number, or personal identification (PIN) code from any internet
14 website maintained by the recorder or used by the recorder to
15 display public records. The request must be made in writing and
16 delivered by mail, facsimile, electronic transmission, or in
17 person to the office of the recorder. The request must specify
18 the personal information to be redacted and identify the
19 document that contains the personal information. Any person who
20 requests a redaction or removal without proper authority to do
21 so is guilty of a petty offense punishable by a fine of not
22 more than $500 for each violation. Within 12 months after the
23 effective date of this amendatory Act of the 95th General

1 Assembly, all county recorders that publicly display records on
2 an internet website must submit a written policy, including a
3 timeline, to the General Assembly and the office of the
4 Illinois Attorney General providing for the removal of all
5 social security numbers from all records available from any
6 website maintained by the recorder. County recorders that
7 launch websites after the effective date of this amendatory Act
8 of the 95th General Assembly shall develop and implement a
9 policy providing for the redaction of social security numbers
10 from all records prior to public display of such records on an
11 internet website.
 
12     Section 10. The State Mandates Act is amended by adding
13 Section 8.32 as follows:
 
14     (30 ILCS 805/8.32 new)
15     Sec. 8.32. Exempt mandate. Notwithstanding Sections 6 and 8
16 of this Act, no reimbursement by the State is required for the
17 implementation of any mandate created by this amendatory Act of
18 the 95th General Assembly.
