AMENDMENT TO SENATE BILL 3018

AMENDMENT NO. ______. Amend Senate Bill 3018 on page 3, by replacing lines 21 through 26 with the following:

"(i) a person who suffers from a permanent physical impairment resulting from disease, injury, functional disorder, or congenital condition that renders the individual incapable of giving informed consent to sexual conduct or sexual penetration;

(ii) a person who suffers from a permanent mental impairment resulting from disease, injury, functional disorder, or congenital condition that impairs the individual's mental ability to independently manage his or her property or financial resources, or both;

(iii) a person who suffers from a permanent physical disability resulting from disease, injury, functional disorder, or congenital condition that impairs the individual's mental or physical ability and is under the care and custody of the State, or resides in a Department of Human Services funded Community Integrated Living Arrangement (CILA);"; and

on page 3, line 27, by replacing "(ii)" with "(iv)"; and

on page 3, line 30, by replacing "(iii)" with "(v)".
