55 ILCS 5/5-1127

    Amends the Counties Code. Provides that a county board may charge a fee to a party requiring the use of or causing the use of a technical rescue team to recover personnel, expendables, and equipment costs.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by changing Section
5 5-1127 as follows:
 
6     (55 ILCS 5/5-1127)
7     Sec. 5-1127. HazMat and technical rescue teams.
8     (a) The county board of any county may, by ordinance,
9 authorize a HazMat team to provide emergency response to
10 chemical and biological terrorism, radiological emergencies,
11 hazardous material spills, releases, or fires, or other
12 contamination events. The county board may make reasonable
13 appropriations from the county treasury to fund and encourage
14 the formation and operation of a Hazmat team. The ordinance may
15 provide for benefits to be paid by the county if a team member
16 suffers disease, injury, or death in the line of duty. A HazMat
17 team authorized under this subsection may be a not-for-profit
18 organization exempt from federal income taxes under Section
19 501(c)(3) of the Internal Revenue Code.
20     (b) The county board of any county may, by ordinance,

22 to building collapse, high angle rescue, and other technical
23 and specialized rescue emergencies. The county board may make
24 reasonable appropriations from the county treasury to fund and
25 encourage the formation and operation of a technical rescue
26 team. The county board may establish a fee to be charged to
27 parties requiring the use of or causing the use of a technical
28 rescue team to recover personnel, expendables, and equipment
29 costs. The ordinance may provide for benefits to be paid by the
30 county if a team member suffers disease, injury, or death in
31 the line of duty. A technical rescue team authorized under this
32 subsection may be a not-for-profit organization exempt from
