AMENDMENT TO SENATE BILL 2049

2     AMENDMENT NO. ______. Amend Senate Bill 2049, AS AMENDED,
3 immediately below the enacting clause, by inserting the
4 following:
 
5     "Section 3. The Department of Transportation Law of the
6 Civil Administrative Code of Illinois is amended by adding
7 Section 2705-565 as follows:
 
8     (20 ILCS 2705/2705-565 new)
9     Sec. 2705-565. North Chicago property; study; conveyance.
10     (a) The Department shall perform a study of property owned
11 by the Department consisting of approximately 160 acres located
12 in North Chicago, south of IL Route 137, between IL Route 43
13 and US Route 41. The study shall include, but not be limited
14 to, a survey of the property for the purpose of delineating
15 jurisdictional wetlands in accordance with the Interagency
16 Wetland Policy Act of 1989 and identifying threatened and
17 endangered species in accordance with the Illinois Endangered
18 Species Protection Act, for the purpose of identifying property
19 no longer needed for highway purposes.
20     (b) Upon completion of the study and for a period ending 3
21 years after the effective date of this amendatory Act of the
22 94th General Assembly, the City of North Chicago shall have an
23 exclusive option to purchase for public purposes those portions
24 of the property no longer needed for highway purposes for a

1 consideration, which may be de minimus, negotiated by the
2 parties. The Department of Transportation is authorized to
3 convey the excess property to the City of North Chicago
4 pursuant to this Section within 3 years after the effective
5 date of this amendatory Act of the 94th General Assembly, but
6 may not otherwise convey or transfer the property during that
7 period.
8     (c) Any conveyance to the City of North Chicago under this
9 Section shall provide (i) that title to the property reverts to
10 the State of Illinois if the property ceases to be used for
11 public purposes and (ii) the City of North Chicago may lease
12 the property but may not convey its ownership of the property
13 to any party, other than the State of Illinois."; and
 
14 after the end of Section 5, by inserting the following:
 
15     "Section 99. Effective date. This Act takes effect upon
16 becoming law.".
