SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2XX new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a person to advertise, represent or imply that any person can earn money working at home by stuffing envelopes, addressing envelopes, mailing circulars, clipping newspaper and magazine articles, assembling products, bill processing, or performing similar work, unless the person making the advertisement or representation meets all of the listed conditions. Effective immediately.

1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2XX as follows:
 
6     (815 ILCS 505/2XX new)
7     Sec. 2XX. Work-at-home solicitations. No person shall
8 advertise, represent or imply that any person can earn money
9 working at home by stuffing envelopes, addressing envelopes,
10 mailing circulars, clipping newspaper and magazine articles,
11 assembling products, bill processing, or performing similar
12 work, unless the person making the advertisement or
13 representation:
14         (1) actually pays the advertised wage, salary, set fee,
15     or commission to others for performing the represented
16     tasks;
17         (2) at no time requires the person who will perform the
18     represented tasks to purchase from the solicitor any
19     instructional booklets, brochures, kits, programs,
20     materials, mailing lists, directories, memberships in
21     cooperative associations, or other similar items or
22     services;
23         (3) discloses the legal name under which business is
24     conducted and the complete street address from which
25     business is actually conducted in all advertising and
26     promotional materials, including order blanks and forms;
27     and
28         (4) discloses in writing to the person who will perform
29     the represented tasks an exact description of the work to
30     be performed and the amount of any wage salary, set fee, or
31     commission to be paid for the performance of the
32     represented tasks.

1     A person who violates this Section commits an unlawful
2 practice within the meaning of this Act.
 
3     Section 99. Effective date. This Act takes effect upon
4 becoming law.
