1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 1-118, 3-107, and 3-406 and by adding Section 1-123.8
6as follows:
 
7    (625 ILCS 5/1-118)  (from Ch. 95 1/2, par. 1-118)
8    Sec. 1-118. Essential Parts. All integral and body parts of
9a vehicle of a type required to be registered hereunder, the
10removal, alteration or substitution of which would tend to
11conceal the identity of the vehicle or substantially alter its
12appearance, model, type or mode of operation. "Essential parts"
13includes the following: vehicle hulks, shells, chassis,
14frames, front end assemblies (which may consist of headlight,
15grill, fenders and hood), front clip (front end assembly with
16cowl attached), rear clip (which may consist of quarter panels,
17fenders, floor and top), doors, hatchbacks, fenders, cabs, cab
18clips, cowls, hoods, trunk lids, deck lids, T-tops, sunroofs,
19moon roofs, astro roofs, transmissions of vehicles of the
20second division, seats, aluminum wheels, engines and similar
21parts. Essential parts shall also include stereo radios,
22cassette radios, compact disc radios, cassette/compact disc
23radios and compact disc players and compact disc changers which

1are either installed in dash or trunk-mounted.
2    An essential part which does not have affixed to it an
3identification number as defined in Section 1-129 adopts the
4identification number of the vehicle to which such part is
5affixed, installed or mounted.
6    An "essential part" does not include an engine,
7transmission, or a rear axle that is used in a glider kit.

10    Sec. 1-123.8. Glider kit. A motor vehicle of the second
11division that includes a chassis, cab, front axle, and other
12essential parts, except for an engine, transmission, or rear
13axle.

15    Sec. 3-107. Contents and effect.
16    (a) Each certificate of title issued by the Secretary of
17State shall contain:
18        1. the date issued;
19        2. the name and address of the owner;
20        3. the names and addresses of any lienholders, in the
21    order of priority as shown on the application or, if the
22    application is based on a certificate of title, as shown on
23    the certificate;
24        4. the title number assigned to the vehicle;

1        5. a description of the vehicle including, so far as
2    the following data exists: its make, year-model,
3    identifying number, type of body, whether new or used, as
4    to house trailers as defined in Section 1-128 of this Code,
5    and as to manufactured homes as defined in Section 1-144.03
6    of this Code, the square footage of the vehicle based upon
7    the outside dimensions excluding the length of the tongue
8    and hitch, and, if a new vehicle, the date of the first
9    sale of the vehicle for use;
10        6. an odometer certification as provided for in this
11    Code; and
12        7. any other data the Secretary of State prescribes.
13    (a-5) In the event the applicant seeks to have the vehicle
14titled as a custom vehicle or street rod, that fact must be
15stated in the application. The custom vehicle or street rod
16must be inspected as required by Section 3-406 of this Code
17prior to issuance of the title. Upon successful completion of
18the inspection, the vehicle may be titled in the following
19manner. The make of the vehicle shall be listed as the make of
20the actual vehicle or the make it is designed to resemble
21(e.g., Ford or Chevrolet); the model of the vehicle shall be
22listed as custom vehicle or street rod; and the year of the
23vehicle shall be listed as the year the actual vehicle was
24manufactured or the year it is designed to resemble. A vehicle
25previously titled as other than a custom vehicle or street rod
26may be issued a corrected title reflecting the custom vehicle

1or street rod model if it otherwise meets the requirements for
2the designation.
3    (a-10) In the event the applicant seeks to have the vehicle
4titled as a glider kit, that fact must be stated in the
5application. The glider kit must be inspected under Section
63-406 of this Code prior to issuance of the title. Upon
7successful completion of the inspection, the vehicle shall be
8titled in the following manner: (1) the make of the vehicle
9shall be listed as the make of the chassis or the make it is
10designed to resemble; (2) the model of the vehicle shall be
11listed as glider kit; and (3) the year of the vehicle shall be
12listed as the year presented on the manufacturer's certificate
13of origin for the chassis, unless no year is presented, then it
14shall be listed as the year the application was received. The
15vehicle identification number of the chassis shall be assigned
16to the engine, transmission, and rear axle if the engine,
17transmission, and rear axle were not previously assigned a
18vehicle identification number after an inspection under
19Section 3-406.
20    (b) The certificate of title shall contain forms for
21assignment and warranty of title by the owner, and for
22assignment and warranty of title by a dealer, and may contain
23forms for applications for a certificate of title by a
24transferee, the naming of a lienholder and the assignment or
25release of the security interest of a lienholder.
26    (b-5) The Secretary of State shall designate on a

1certificate of title a space where the owner of a vehicle may
2designate a beneficiary, to whom ownership of the vehicle shall
3pass in the event of the owner's death.
4    (c) A certificate of title issued by the Secretary of State
5is prima facie evidence of the facts appearing on it.
6    (d) A certificate of title for a vehicle is not subject to
7garnishment, attachment, execution or other judicial process,
8but this subsection does not prevent a lawful levy upon the
9vehicle.
10    (e) Any certificate of title issued by the Secretary of
11State is subject to a lien in favor of the State of Illinois
12for any fees or taxes required to be paid under this Act and as
13have not been paid, as provided for in this Code.
14    (f) Notwithstanding any other provision of law, a
15certificate of title issued by the Secretary of State to a
16manufactured home is prima facie evidence of the facts
17appearing on it, notwithstanding the fact that such
18manufactured home, at any time, shall have become affixed in
19any manner to real property.

22    Sec. 3-406. Application for specially constructed,
23reconstructed, custom, street rod, or foreign vehicles, or
24glider kits.
25    (a) In the event the vehicle to be registered is a

1specially constructed, reconstructed or foreign vehicle, such
2fact shall be stated in the application and with reference to
3every foreign vehicle which has been registered heretofore
4outside of this State the owner shall surrender to the
5Secretary of State all registration plates, registration cards
6or other evidence of such foreign registration as may be in his
7possession or under his control except as provided in
8subdivision (b) hereof.
9    (b) Where in the course of interstate operation of a
10vehicle registered in another State, it is desirable to retain
11registration of said vehicle in such other State, such
12applicant need not surrender but shall submit for inspection
13said evidences of such foreign registration and the Secretary
14of State upon a proper showing shall register said vehicle in
15this State but shall not issue a certificate of title for such
16vehicle.
17    (c) In the event the applicant seeks to have the vehicle
18registered as a custom vehicle or street rod, that fact must be
19stated in the application. Prior to registration, custom
20vehicles or street rods must be inspected by the Secretary of
21State Department of Police. Upon successful completion of the
22inspection, the vehicle may be registered in the following
23manner. The make of the vehicle shall be listed as the make of
24the actual vehicle or the make it is designed to resemble
25(e.g., Ford or Chevrolet); the model of the vehicle shall be
26listed as custom vehicle or street rod; and the year of the

1vehicle shall be listed as the year the actual vehicle was
2manufactured or the year it is designed to resemble.
3    (d) In the event the applicant seeks to have the vehicle
4registered as a glider kit, that fact must be stated in the
5application. Each glider kit sought to be registered shall be
6inspected by the Secretary of State Department of Police who
7shall verify the chassis, cab, front axle, and other essential
8parts as acceptable. Upon successful completion of the
9inspection, the vehicle may be registered in the following
10manner: (1) the make of the vehicle shall be listed as the make
11of the chassis of the actual manufacturer; (2) the model of the
12vehicle shall be listed as glider kit; and (3) the year of the
13vehicle shall be listed as the year presented on the
14manufacturer's certificate of origin for the chassis, unless no
15year is presented, then it shall be listed as the year the
16application is received.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.
