AMENDMENT TO SENATE BILL 3018

2    AMENDMENT NO. ______. Amend Senate Bill 3018 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 1-118, 3-107, and 3-406 and by adding Section
61-123.8 as follows:
 
7    (625 ILCS 5/1-118)  (from Ch. 95 1/2, par. 1-118)
8    Sec. 1-118. Essential Parts. All integral and body parts of
9a vehicle of a type required to be registered hereunder, the
10removal, alteration or substitution of which would tend to
11conceal the identity of the vehicle or substantially alter its
12appearance, model, type or mode of operation. "Essential parts"
13includes the following: vehicle hulks, shells, chassis,
14frames, front end assemblies (which may consist of headlight,
15grill, fenders and hood), front clip (front end assembly with
16cowl attached), rear clip (which may consist of quarter panels,

1fenders, floor and top), doors, hatchbacks, fenders, cabs, cab
2clips, cowls, hoods, trunk lids, deck lids, T-tops, sunroofs,
3moon roofs, astro roofs, transmissions of vehicles of the
4second division, seats, aluminum wheels, engines and similar
5parts. Essential parts shall also include stereo radios,
6cassette radios, compact disc radios, cassette/compact disc
7radios and compact disc players and compact disc changers which
8are either installed in dash or trunk-mounted.
9    An essential part which does not have affixed to it an
10identification number as defined in Section 1-129 adopts the
11identification number of the vehicle to which such part is
12affixed, installed or mounted.
13    An "essential part" does not include an engine,
14transmission, or a rear axle that is used in a glider kit.

17    Sec. 1-123.8. Glider kit. A motor vehicle of the second
18division that includes a chassis, cab, front axle, and other
19essential parts, except for an engine, transmission, or rear
20axle.

22    Sec. 3-107. Contents and effect.
23    (a) Each certificate of title issued by the Secretary of
24State shall contain:

1        1. the date issued;
2        2. the name and address of the owner;
3        3. the names and addresses of any lienholders, in the
4    order of priority as shown on the application or, if the
5    application is based on a certificate of title, as shown on
6    the certificate;
7        4. the title number assigned to the vehicle;
8        5. a description of the vehicle including, so far as
9    the following data exists: its make, year-model,
10    identifying number, type of body, whether new or used, as
11    to house trailers as defined in Section 1-128 of this Code,
12    and as to manufactured homes as defined in Section 1-144.03
13    of this Code, the square footage of the vehicle based upon
14    the outside dimensions excluding the length of the tongue
15    and hitch, and, if a new vehicle, the date of the first
16    sale of the vehicle for use;
17        6. an odometer certification as provided for in this
18    Code; and
19        7. any other data the Secretary of State prescribes.
20    (a-5) In the event the applicant seeks to have the vehicle
21titled as a custom vehicle or street rod, that fact must be
22stated in the application. The custom vehicle or street rod
23must be inspected as required by Section 3-406 of this Code
24prior to issuance of the title. Upon successful completion of
25the inspection, the vehicle may be titled in the following
26manner. The make of the vehicle shall be listed as the make of

1the actual vehicle or the make it is designed to resemble
2(e.g., Ford or Chevrolet); the model of the vehicle shall be
3listed as custom vehicle or street rod; and the year of the
4vehicle shall be listed as the year the actual vehicle was
5manufactured or the year it is designed to resemble. A vehicle
6previously titled as other than a custom vehicle or street rod
7may be issued a corrected title reflecting the custom vehicle
8or street rod model if it otherwise meets the requirements for
9the designation.
10    (a-10) In the event the applicant seeks to have the vehicle
11titled as a glider kit, that fact must be stated in the
12application. The glider kit must be inspected under Section
133-406 of this Code prior to issuance of the title. Upon
14successful completion of the inspection, the vehicle shall be
15titled in the following manner: (1) the make of the vehicle
16shall be listed as the make of the chassis or the make it is
17designed to resemble; (2) the model of the vehicle shall be
18listed as glider kit; and (3) the year of the vehicle shall be
19listed as the year presented on the manufacturer's certificate
20of origin for the chassis, unless no year is presented, then it
21shall be listed as the year the application was received. The
22vehicle identification number of the chassis shall be assigned
23to the engine, transmission, and rear axle if the engine,
24transmission, and rear axle were not previously assigned a
25vehicle identification number after an inspection under
26Section 3-406.

1    (b) The certificate of title shall contain forms for
2assignment and warranty of title by the owner, and for
3assignment and warranty of title by a dealer, and may contain
4forms for applications for a certificate of title by a
5transferee, the naming of a lienholder and the assignment or
6release of the security interest of a lienholder.
7    (b-5) The Secretary of State shall designate on a
8certificate of title a space where the owner of a vehicle may
9designate a beneficiary, to whom ownership of the vehicle shall
10pass in the event of the owner's death.
11    (c) A certificate of title issued by the Secretary of State
12is prima facie evidence of the facts appearing on it.
13    (d) A certificate of title for a vehicle is not subject to
14garnishment, attachment, execution or other judicial process,
15but this subsection does not prevent a lawful levy upon the
16vehicle.
17    (e) Any certificate of title issued by the Secretary of
18State is subject to a lien in favor of the State of Illinois
19for any fees or taxes required to be paid under this Act and as
20have not been paid, as provided for in this Code.
21    (f) Notwithstanding any other provision of law, a
22certificate of title issued by the Secretary of State to a
23manufactured home is prima facie evidence of the facts
24appearing on it, notwithstanding the fact that such
25manufactured home, at any time, shall have become affixed in
26any manner to real property.

3    Sec. 3-406. Application for specially constructed,
4reconstructed, custom, street rod, or foreign vehicles, or
5glider kits.
6    (a) In the event the vehicle to be registered is a
7specially constructed, reconstructed or foreign vehicle, such
8fact shall be stated in the application and with reference to
9every foreign vehicle which has been registered heretofore
10outside of this State the owner shall surrender to the
11Secretary of State all registration plates, registration cards
12or other evidence of such foreign registration as may be in his
13possession or under his control except as provided in
14subdivision (b) hereof.
15    (b) Where in the course of interstate operation of a
16vehicle registered in another State, it is desirable to retain
17registration of said vehicle in such other State, such
18applicant need not surrender but shall submit for inspection
19said evidences of such foreign registration and the Secretary
20of State upon a proper showing shall register said vehicle in
21this State but shall not issue a certificate of title for such
22vehicle.
23    (c) In the event the applicant seeks to have the vehicle
24registered as a custom vehicle or street rod, that fact must be
25stated in the application. Prior to registration, custom

1vehicles or street rods must be inspected by the Secretary of
2State Department of Police. Upon successful completion of the
3inspection, the vehicle may be registered in the following
4manner. The make of the vehicle shall be listed as the make of
5the actual vehicle or the make it is designed to resemble
6(e.g., Ford or Chevrolet); the model of the vehicle shall be
7listed as custom vehicle or street rod; and the year of the
8vehicle shall be listed as the year the actual vehicle was
9manufactured or the year it is designed to resemble.
10    (d) In the event the applicant seeks to have the vehicle
11registered as a glider kit, that fact must be stated in the
12application. Each glider kit sought to be registered shall be
13inspected by the Secretary of State Department of Police who
14shall verify the chassis, cab, front axle, and other essential
15parts as acceptable. Upon successful completion of the
16inspection, the vehicle may be registered in the following
17manner: (1) the make of the vehicle shall be listed as the make
18of the chassis of the actual manufacturer; (2) the model of the
19vehicle shall be listed as glider kit; and (3) the year of the
20vehicle shall be listed as the year presented on the
21manufacturer's certificate of origin for the chassis, unless no
22year is presented, then it shall be listed as the year the
23application is received.
