1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Sections 22.38a and 22.54b as follows:
 
6    (415 ILCS 5/22.38a new)
7    Sec. 22.38a. Limitation on fees assessed by local
8government on facilities accepting exclusively general
9construction and demolition debris. Except in counties with a
10population in excess of 1,500,000 residents, a facility
11regulated under Section 22.38 of this Act shall not be subject
12to annual fees assessed by a unit of local government and that
13are directly related to the facility's recycling activities in
14excess of $2,000. A home rule unit may not regulate these fees
15in a manner that is inconsistent with this Section. This
16Section is a limitation under subsection (i) of Section 6 of
17Article VII of the Illinois Constitution on the concurrent
18exercise by home rule units of powers and functions exercised
19by the State.

21    Sec. 22.54b. Limitation on fees assessed by local
22government on facilities that have received a beneficial use

1determination. Except in counties with a population in excess
2of 1,500,000 residents, a facility that has received a
3beneficial use determination from the Agency under Section
422.54 of this Act shall not be subject to annual fees assessed
5by a unit of local government and that are directly related to
6the facility's recycling activities in excess of $1,500. A home
7rule unit may not regulate these fees in a manner that is
8inconsistent with this Section. This Section is a limitation
9under subsection (i) of Section 6 of Article VII of the
10Illinois Constitution on the concurrent exercise by home rule
11units of powers and functions exercised by the State.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
