AMENDMENT TO SENATE BILL 1408

2    AMENDMENT NO. ______. Amend Senate Bill 1408, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Environmental Protection Act is amended by
6adding Sections 22.38a and 22.54b as follows:
 
7    (415 ILCS 5/22.38a new)
8    Sec. 22.38a. Limitation on fees assessed by local
9government on facilities accepting exclusively general
10construction and demolition debris. Except in counties with a
11population in excess of 1,500,000 residents, a facility
12regulated under Section 22.38 of this Act shall not be subject
13to annual fees assessed by a unit of local government that are
14directly related to the facility's recycling activities. In
15counties with a population in excess of 1,500,000 residents,
16annual fees assessed by a unit of local government shall not

1exceed $2,000. Further, fees collected by a unit of local
2government from a facility regulated under Section 22.38 of
3this Act may only be used for inspection of these facilities
4and enforcement of applicable environmental standards.
 
5    (415 ILCS 5/22.54b new)
6    Sec. 22.54b. Limitation on fees assessed by local
7government on facilities that have received a beneficial use
8determination. Except in counties with a population in excess
9of 1,500,000 residents, a facility that has received a
10beneficial use determination from the Agency under Section
1122.54 of this Act shall not be subject to annual fees assessed
12by a unit of local government that are directly related to the
13facility's recycling activities. In counties with a population
14in excess of 1,500,000 residents, annual fees assessed by a
15unit of local government shall not exceed $1,5000. Further,
16fees collected by a unit of local government from a facility
17regulated under Section 22.54 of this Act may only be used for
18inspection of these facilities and enforcement of applicable
19environmental standards.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
