SYNOPSIS AS INTRODUCED:

15 ILCS 505/25 new
30 ILCS 105/5.855 new

    Amends the State Treasurer Act. Permits the State Treasurer to retain an administrative charge for the costs of services associated with the deposit of moneys that are remitted directly to the State Treasurer. Provides that the amount of the administrative charge may be determined by the State Treasurer and shall not exceed 2% of the amount deposited. Provides that this charge shall apply to fines, fees, or other amounts remitted directly to the State Treasurer by circuit clerks, county clerks, and other entities that are not State agencies for deposit into a fund in the State treasury. Provides that the charge shall apply to any form of fines, fees, or other collections created on or after the effective date of the amendatory Act. Sets forth provisions governing the State Treasurer's Administrative Fund. Amends the State Finance Act and creates the State Treasurer's Administrative Fund. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Treasurer Act is amended by adding
5Sections 20 and 25 as follows:
 
6    (15 ILCS 505/20 new)
7    Sec. 20. State Treasurer administrative charge. The State
8Treasurer may retain an administrative charge for the costs of
9services associated with the deposit of moneys that are
10remitted directly to the State Treasurer. The administrative
11charge collected under this Section shall be deposited into the
12State Treasurer's Administrative Fund. The amount of the
13administrative charge may be determined by the State Treasurer
14and shall not exceed 2% of the amount deposited.
15    This Section shall apply to fines, fees, or other amounts
16remitted directly to the State Treasurer by circuit clerks,
17county clerks, and other entities that are not State agencies
18for deposit into a fund in the State treasury. This Section
19shall apply only to any form of fines, fees, or other
20collections created on or after the effective date of this
21amendatory Act of the 98th General Assembly.

1    Sec. 25. State Treasurer's Administrative Fund. All cost
2recoveries, fees for services, and governmental grants
3received by the State Treasurer shall be maintained in a trust
4fund in the State treasury, to be known as the State
5Treasurer's Administrative Fund. Moneys in the State
6Treasurer's Administrative Fund may be utilized by the State
7Treasurer in the discharge of the duties of the office. All
8interest earned by the investment or deposit of moneys
9accumulated in the Fund shall be deposited into the Fund.
 
10    Section 10. The State Finance Act is amended by adding
11Section 5.855 as follows:

13    Sec. 5.855. The State Treasurer's Administrative Fund.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
