SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Illinois Sustainable Highways Act. Requires all State-funded transportation construction projects to set aside 2% of the total funds allocated for that State construction project. Provides that a percentage of this money shall be used to address water pollution concerns for each construction project on a case-by-case basis and the rest of the money shall be used to implement sustainable stormwater management procedures and best management practices. Effective immediately.

1     AN ACT concerning State highways.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Illinois Sustainable Highways Act.
 
6     Section 5. Findings. The General Assembly makes the
7 following findings:
8     (1) Transportation infrastructure, including roads and
9 parking lots, that is constructed with impervious surfaces
10 causes pollution of Illinois waterways.
11     (2) Stormwater collects a high concentration of
12 contaminants on impervious surfaces that are then washed into
13 streams, rivers, lakes, and storm sewers.
14     (3) Numerous technologies exist that can be incorporated
15 into transportation infrastructure to control stormwater and
16 mitigate non-point source water pollution.
 
17     Section 10. Applicability.
18     (a) All State-funded transportation construction projects
19 must set aside 2% of the total funds allocated for that State
20 construction project. A percentage of this money shall be used
21 to address water pollution concerns for each construction
22 project on a case-by-case basis and the rest of the money shall

1 be used to implement sustainable stormwater management
2 procedures and best management practices.
3     (b) For the purposes of this Section, "best management
4 practices" includes the installation of sustainable materials,
5 such as pervious or porous concrete, recycled asphalt pavement,
6 recycled concrete, bioretention swale, grassy swale, sand
7 filters, and wet ponds, based on the latest technology and
8 research in areas such as medians, road shoulders, parking
9 lots, ramps, investigation areas, and pull-off areas.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.
