SYNOPSIS AS INTRODUCED:

65 ILCS 5/10-3-3.1

Amends the Municipal Code. In a Section that provides that a non-home rule unit shall not assign a fireman to perform police duties or a policeman to perform firefighting duties, provides that the Section does not apply to municipalities with a population of less than 60,000. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by changing Section 10-3-3.1 as follows:

(65 ILCS 5/10-3-3.1)

Sec. 10-3-3.1. Distinct police and fire duties. A non-home rule municipality shall not assign a "fireman", as defined in Section 10-3-2, to perform police duties or a "policeman", as defined in Section 10-3-1, to perform firefighting duties or in any way combine the duties of a fireman or a policeman after his or her appointment from a police department or fire department register of eligibles. A non-home rule municipality shall not administer its fire department's or police department's regular work assignments in a manner inconsistent with this Section. This Section does not apply to any municipality that created a department of public safety before January 1, 1998. This Section does not apply to municipalities with a population of less than 60,000.

Section 99. Effective date. This Act takes effect upon becoming law.
