1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Firearm Owners Identification Card Act is
5 amended by changing Section 5 as follows:
 
6     (430 ILCS 65/5)  (from Ch. 38, par. 83-5)
7     Sec. 5. (a) The Department of State Police shall either
8 approve or deny all applications within 30 days from the date
9 they are received, and every applicant found qualified pursuant
10 to Section 8 of this Act by the Department shall be entitled to
11 a Firearm Owner's Identification Card upon the payment of a $5
12 fee. $3 of each fee derived from the issuance of Firearm
13 Owner's Identification Cards, or renewals thereof, shall be
14 deposited in the Wildlife and Fish Fund in the State Treasury;
15 $1 of such fee shall be deposited in the General Revenue Fund
16 in the State Treasury and $1 of such fee shall be deposited in
17 the Firearm Owner's Notification Fund. Monies in the Firearm
18 Owner's Notification Fund shall be used exclusively to pay for
19 the cost of sending notices of expiration of Firearm Owner's
20 Identification Cards under Section 13.2 of this Act. Excess
21 monies in the Firearm Owner's Notification Fund shall be used
22 to ensure the prompt and efficient processing of applications
23 received under Section 4 of this Act.
24     (b) The renewal application of an applicant found qualified
25 pursuant to Section 8 of this Act or proof of payment of the $5
26 fee as required under subsection (a) of this Section, shall
27 serve as valid proof of a Firearm Owner's Identification Card
28 until it is issued in cases where the Department of State
29 Police fails to approve the renewal application of a qualified
30 applicant within 30 days from the date it was received.
