SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/5   from Ch. 38, par. 83-5

    Amends the Firearm Owners Identification Card Act. Provides that the application of an applicant found qualified under the Act or proof of payment of the $5 Firearm Owner's Identification Card fee, shall serve as valid proof of a Firearm Owner's Identification Card until it is issued in cases where the Department of State Police fails to approve the application of a qualified applicant within 30 days from the date it was received.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Firearm Owners Identification Card Act is
5 amended by changing Section 5 as follows:
 
6     (430 ILCS 65/5)  (from Ch. 38, par. 83-5)
7     Sec. 5.
8     (a) The Department of State Police shall either approve or
9 deny all applications within 30 days from the date they are
10 received, and every applicant found qualified pursuant to
11 Section 8 of this Act by the Department shall be entitled to a
12 Firearm Owner's Identification Card upon the payment of a $5
13 fee. $3 of each fee derived from the issuance of Firearm
14 Owner's Identification Cards, or renewals thereof, shall be
15 deposited in the Wildlife and Fish Fund in the State Treasury;
16 $1 of such fee shall be deposited in the General Revenue Fund
17 in the State Treasury and $1 of such fee shall be deposited in
18 the Firearm Owner's Notification Fund. Monies in the Firearm
19 Owner's Notification Fund shall be used exclusively to pay for
20 the cost of sending notices of expiration of Firearm Owner's
21 Identification Cards under Section 13.2 of this Act. Excess
22 monies in the Firearm Owner's Notification Fund shall be used
23 to ensure the prompt and efficient processing of applications
24 received under Section 4 of this Act.
25     (b) The application of an applicant found qualified
26 pursuant to Section 8 of this Act or proof of payment of the $5
27 fee as required under subsection (a) of this Section, shall
28 serve as valid proof of a Firearm Owner's Identification Card
29 until it is issued in cases where the Department of State
30 Police fails to approve the application of a qualified
31 applicant within 30 days from the date it was received.
