1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Vector Control Act is amended by changing
5Section 2 and by adding Sections 1.5 and 3.5 as follows:
 
6    (410 ILCS 95/1.5 new)
7    Sec. 1.5. Legislative intent. The General Assembly
8recognizes that:
9    (1) climate change is a factor in future mosquito-borne
10and vector-borne diseases;
11    (2) there is a need to ensure environmental protection as
12well as the protection of public health and the quality of
13life; and
14    (3) an integrated pest management approach is the best way
15to balancing these goals.

17    Sec. 2. For the purposes of this Act:
18    "Arthropod" means a mosquito or other invertebrate animal
19with jointed legs and a segmented body.
20    "Commercial pesticide applicator" means a person certified
21or licensed under the Structural Pest Control Act or the
22Illinois Pesticide Act who contracts to apply a pesticide

1within the scope of his or her certification or license.
2    "Department" means the Illinois Department of Public
3Health.
4    "Director" means the Director of the Illinois Department
5of Public Health.
6    "Integrated pest management" means modification of the
7life system of a vector or pest to reduce its numbers to an
8acceptable level by applying current biological and
9technological knowledge to achieve the desired modification in
10a manner that ensures protection of the environment and public
11health.
12    "Integrated vector management approach" means an approach
13that prioritizes prevention, biological, and nonchemical means
14of controlling disease vectors and prioritizes a data-driven
15approach to vector management.
16    "Local health authority" means the full-time health
17department, as recognized by the Department, having
18jurisdiction over a particular area.
19    "Pest" means undesirable arthropods (including certain
20insects, spiders, mites, ticks and related organisms), wood
21infesting organisms, rats, mice, birds and any other obnoxious
22or undesirable animals.
23    "Vector" means arthropods, rats, mice, birds or other
24animals capable of carrying disease-producing organisms to a
25human or animal host. "Vector" does not include animals that
26transmit disease to humans only when used as human food.

2    (410 ILCS 95/3.5 new)
3    Sec. 3.5. Integrated vector management plan; public
4notification prior to use of wide-area chemical pesticides
5from the public right of way.
6    (a) An organization performing mosquito control as a
7public service shall submit to the Department a written
8integrated vector management plan.
9    (b) This Section does not apply to the Department mosquito
10control grantees who are supervised by the Department on the
11effective date of this amendatory Act of the 103rd General
12Assembly.
13    (c) This Section does not apply to any business or person
14regulated under the Structural Pest Control Act.
15    (d) A vector management organization shall establish and
16maintain a system of public notification prior to the use of
17wide-area chemical pesticides from the public right of way.
18    (e) A vector management plan shall consist of a plan for
19the prevention, biological, and nonchemical means of
20controlling disease vectors based upon scientific data
21prescribed by the Department.
 
22    Section 99. Effective date. This Act takes effect January
231, 2024.
