Synopsis As Introduced
Amends the Conveyances Act. Makes a technical change in the Section relating to the effect of the transfer of land.

Deletes reference to:

Adds reference to:
765 ILCS 77/70

Replaces everything after the enacting clause with provisions that amend the Residential Real Property Disclosure Act. Provides that the title insurance company or closing agent shall attach to the mortgage a certificate of compliance with the requirements of the Act or a certificate of exemption (instead of requirements of the Act), as generated by the database. If the title insurance company or closing agent fails to attach either the certificate of compliance or the certificate of exemption (instead of attach the certificate of compliance), then the mortgage is not recordable. Provides that the failure to attach the appropriate certificate shall not affect the enforceability of the lien of the mortgage.

House Committee Amendment No. 1
Further amends the Residential Real Property Disclosure Act. Defines "certificate of compliance" and "certificate of exemption". Provides that the failure to attach a certificate of exemption, if the requirements for an exemption are met, (instead of the failure to attach the appropriate certificate) shall not affect the enforceability of the lien of mortgage.

House Floor Amendment No. 3
Provides that the failure to attach a certificate of exemption, if the requirements for an exemption are met, shall not affect the validity, enforceability, or priority (instead of the enforceability) of the lien of the mortgage.
