 1                    AMENDMENT TO SENATE BILL 544

 2        AMENDMENT NO.     .  Amend Senate Bill 544  by  replacing
 3    the title with the following:
 4        "AN  ACT to amend the Children's Health Insurance Program
 5    Act by changing Sections 30, 55, and 60."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.  The Children's Health Insurance Program Act
 9    is amended by changing Sections 30, 55, and 60 as follows:

10        (215 ILCS 106/30)
11        (Section scheduled to be repealed on June 30, 2001)
12        Sec. 30.  Cost sharing.
13        (a)  Children  enrolled  in  a  health  benefits  program
14    pursuant to subdivision (a)(2) of Section 25 shall be subject
15    to the following cost sharing requirements:
16             (1)  There  shall  be  no  co-payment  required  for
17        well-baby or well-child care,  including  age-appropriate
18        immunizations as required under federal law.
19             (2)  Health   insurance  premiums  for  children  in
20        families whose household income is at or  above  150%  of
21        the  federal  poverty  level  shall  be  payable monthly,

 1        subject to rules promulgated by the Department for  grace
 2        periods and advance payments, and shall be as follows:
 3                  (A)  $15 per month for one child.
 4                  (B)  $25 per month for 2 children.
 5                  (C)  $30 per month for 3 or more children.
 6             (3)  Co-payments  for  children  in  families  whose
 7        income  is at or below 150% of the federal poverty level,
 8        at a minimum and to the extent  permitted  under  federal
 9        law, shall be $2 for all medical visits and prescriptions
10        provided under this Act.
11             (4)  Co-payments  for  children  in  families  whose
12        income  is at or above 150% of the federal poverty level,
13        at a minimum and to the extent  permitted  under  federal
14        law shall be as follows:
15                  (A)  $5 for medical visits.
16                  (B)  $3  for  generic  prescriptions and $5 for
17             brand name prescriptions.
18                  (C)  $25  for  emergency   room   use   for   a
19             non-emergency situation as defined by the Department
20             by rule.
21             (5)  The  maximum  amount  of out-of-pocket expenses
22        for co-payments shall be $100 per family per year.
23        (b)  Individuals enrolled in a privately sponsored health
24    insurance plan pursuant to subdivision (a)(1) of  Section  25
25    shall  be subject to the cost sharing provisions as stated in
26    the privately sponsored health insurance plan.

30        Sec. 55.  Contracts with  non-governmental  bodies.   All
31    contracts with non-governmental bodies that are determined by
32    the Department to be necessary for the implementation of this
33    Act  Section  are deemed to be purchase of care as defined in

 1    the Illinois Procurement Code.

 5        Sec. 60.  Emergency rulemaking.  Prior to June 30,  1999,
 6    the  Department  may  adopt  rules necessary to establish and
 7    implement this Act  Section  through  the  use  of  emergency
 8    rulemaking  in  accordance  with Section 5-45 of the Illinois
 9    Administrative Procedure Act.  For purposes of that Act,  the
10    General   Assembly  finds  that  the  adoption  of  rules  to
11    implement  this  Act  Section  is  deemed  an  emergency  and
12    necessary for the public interest, safety, and welfare.

14        Section 99.  Effective date.  This Act takes effect  upon
15    becoming law.".
