1 AMENDMENT TO HOUSE BILL 90
2 AMENDMENT NO. . Amend House Bill 90 on page 1, line
3 2 by changing "Sections 1-7, 5-120, and 5-125" to "Section
4 1-7"; and
5 on page 1, line 6 by changing "Sections 1-7, 5-120, and
6 5-125" to "Section 1-7"; and
7 on page 4, line 25 by changing "Law" to "Except as otherwise
8 provided in this subsection (E), law"; and
9 on page 4, by replacing lines 28 through 34 with the
10 following:
11 "case involving a minor.
12 Upon petition by the victim or the victim's legal
13 representative, and after a showing of the necessity for the
14 disclosure by clear and convincing evidence, the court may
15 order that the following information be disclosed to the
16 victim or the victim's legal representative:
17 (i) If the minor is a not ward of the State, the
18 court may order the disclosure of the names and addresses
19 of the minor and the minor's parents or guardian and
20 information pertaining to any disposition or alternative
21 adjustment plan for the minor.
22 (ii) If the minor is a ward of the State, the court

1 may order the disclosure of only the name and address of
2 the minor's guardian.
3 In making the required showing of necessity for the
4 disclosure, the petitioner shall bear the burden of showing
5 the necessity for the disclosure."; and
6 by deleting lines 21 through 32 on page 5 and all of page 6.
