1 AMENDMENT TO HOUSE BILL 2843
2 AMENDMENT NO. . Amend House Bill 2843 by replacing
3 the title with the following:
4 "AN ACT to amend the Illinois Municipal Code by adding
5 Division 2.2 to Article 1."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Municipal Code is amended by
9 adding Division 2.2 to Article 1 as follows:
10 (65 ILCS 5/Art. 1, Div. 2.2 heading new)
11 DIVISION 2.2. CODE HEARINGS
12 (65 ILCS 5/1-2.2-1 new)
13 Sec. 1-2.2-1. Applicability. This Division 2.2 applies
14 only to municipalities that are not home rule units. Nothing
15 in this Division 2.2 allows a non-home rule municipality to
16 pursue any remedies not otherwise authorized by statute.

18 Sec. 1-2.2-5. Code hearing department. Any municipality

1 may provide by ordinance for a code hearing department to
2 adjudicate any violation of a municipal ordinance, except for
3 any offense under the Illinois Vehicle Code or a similar
4 offense that is a traffic regulation governing the movement
5 of vehicles and except for any reportable offense under
6 Section 6-204 of the Illinois Vehicle Code.

8 Sec. 1-2.2-10. Procedures. A code hearing department
9 created under this Division 2.2 shall follow the same
10 procedures as in Division 31.1 of Article 11 of this Code, to
11 the extent they are applicable, except that the provisions of
12 Section 11-31.1-9 shall apply only to building and zoning
13 violations.".
