1 AMENDMENT TO HOUSE BILL 2282
2 AMENDMENT NO. . Amend House Bill 2282 by replacing
3 the title with the following:
4 "AN ACT to amend the Producer Controlled Insurer Act by
5 changing Section 20."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Producer Controlled Insurer Act is
9 amended by changing Section 20 as follow:
10 (215 ILCS 107/20)
11 Sec. 20. Disclosure. The producer shall deliver written
12 notice to the prospective insured before the effective date
13 of any policy disclosing the relationship between the
14 producer and the controlled insurer; except that if the
15 business is placed through a subproducer who is not a
16 controlling producer, the controlling producer shall retain
17 in his records a signed commitment from the subproducer that
18 the subproducer is aware of the relationship between the
19 controlling producer and the insurer and that the subproducer
20 has or will notify the insured and except that if the
21 business is placed for a governmental reciprocal, the

1 execution by a prospective subscriber of the subscriber's
2 agreement, which the governmental reciprocal shall retain in
3 its records, shall constitute compliance with this Section by
4 the governmental reciprocal, the controlling producer, and
5 any subproducer who is not a controlling producer. The
6 requirements of this Section apply to all policies written or
7 renewed more than 59 days after the effective date of this
8 Act.

10 Section 99. Effective date. This Act takes effect upon
11 becoming law.".
