1 AN ACT concerning counties.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Counties Code is amended by changing
5 Sections 3-10007, 4-6001, 4-6002, 4-6003, and 4-8002 as
6 follows:

8 Sec. 3-10007. Annual stipend. In addition to all other
9 compensation provided by law, every elected county treasurer,
10 for additional duties mandated by State law, shall receive an
11 annual stipend of (i) $5,000 if his or her term begins before
12 December 1, 1998, (ii) $5,500 after December 1, 1998 and
13 $6,500 after December 1, 1999 if his or her term begins on or
14 after December 1, 1998 but before December 1, 2000, and (iii)
15 $6,500 if his or her term begins December 1, 2000 or
16 thereafter, to be annually appropriated from the General
17 Revenue Fund by the General Assembly to the Department of
18 Revenue which shall distribute the awards in annual lump sum
19 payments to every elected county treasurer. This annual
20 stipend shall not affect any other compensation provided by
21 law to be paid to elected county treasurers. No county board
22 may reduce or otherwise impair the compensation payable from
23 county funds to an elected county treasurer if such reduction
24 or impairment is the result of his receiving an annual
25 stipend under this Section. Notwithstanding any provision to
26 the contrary, upon the expiration of the term of the county
27 treasurer in office at the time of the effective date of this
28 amendatory Act of the 93rd General Assembly, no stipends
29 shall be appropriated by the General Assembly for the
30 purposes of this subsection and no stipends shall be paid
31 under the provisions of this subsection to the treasurer of

4 Sec. 4-6001. Officers in counties of less than
5 2,000,000.
6 (a) In all counties of less than 2,000,000 inhabitants,
7 the compensation of Coroners, County Treasurers, County
8 Clerks, Recorders and Auditors shall be determined under this
9 Section. The County Board in those counties shall fix the
10 amount of the necessary clerk hire, stationery, fuel and
11 other expenses of those officers. The compensation of those
12 officers shall be separate from the necessary clerk hire,
13 stationery, fuel and other expenses, and such compensation
14 (except for coroners in those counties with less than
15 2,000,000 population in which the coroner's compensation is
16 set in accordance with Section 4-6002) shall be fixed within
17 the following limits:
18 To each such officer in counties containing less than
19 14,000 inhabitants, not less than $13,500 per annum.
20 To each such officer in counties containing 14,000 or
21 more inhabitants, but less than 30,000 inhabitants, not less
22 than $14,500 per annum.
23 To each such officer in counties containing 30,000 or
24 more inhabitants but less than 60,000 inhabitants, not less
25 than $15,000 per annum.
26 To each such officer in counties containing 60,000 or
27 more inhabitants but less than 100,000 inhabitants, not less
28 than $15,000 per annum.
29 To each such officer in counties containing 100,000 or
30 more inhabitants but less than 200,000 inhabitants, not less
31 than $16,500 per annum.
32 To each such officer in counties containing 200,000 or
33 more inhabitants but less than 300,000 inhabitants, not less

1 than $18,000 per annum.
2 To each such officer in counties containing 300,000 or
3 more inhabitants but less than 2,000,000 inhabitants, not
4 less than $20,000 per annum.
5 (b) Those officers beginning a term of office before
6 December 1, 1990 shall be compensated at the rate of their
7 base salary. "Base salary" is the compensation paid for each
8 of those offices, respectively, before July 1, 1989.
9 (c) Those officers beginning a term of office on or
10 after December 1, 1990 shall be compensated as follows:
11 (1) Beginning December 1, 1990, base salary plus at
12 least 3% of base salary.
13 (2) Beginning December 1, 1991, base salary plus at
14 least 6% of base salary.
15 (3) Beginning December 1, 1992, base salary plus at
16 least 9% of base salary.
17 (4) Beginning December 1, 1993, base salary plus at
18 least 12% of base salary.
19 (d) In addition to but separate and apart from the
20 compensation provided in this Section, the county clerk of
21 each county, the recorder of each county, and the chief clerk
22 of each county board of election commissioners shall receive
23 an award as follows:
24 (1) $4,500 per year after January 1, 1998;
25 (2) $5,500 per year after January 1, 1999; and
26 (3) $6,500 per year after January 1, 2000.
27 The total amount required for such awards each year shall
28 be appropriated by the General Assembly to the State Board of
29 Elections which shall distribute the awards in annual lump
30 sum payments to the several county clerks, recorders, and
31 chief election clerks. Beginning December 1, 1990, this
32 annual award, and any other award or stipend paid out of
33 State funds to county officers, shall not affect any other
34 compensation provided by law to be paid to county officers.

1 Notwithstanding any other provision to the contrary, upon
2 the expiration of the term of the county clerk of each
3 county, the recorder of each county, and the chief clerk of
4 each county board of election commissioners in office at the
5 time of the effective date of this amendatory Act of the 93rd
6 General Assembly, no awards shall be appropriated by the
7 General Assembly for the purposes of this subsection and no
8 awards shall be paid under the provisions of this subsection
9 to the individuals holding those offices.
10 (e) Beginning December 1, 1990, no county board may
11 reduce or otherwise impair the compensation payable from
12 county funds to a county officer if the reduction or
13 impairment is the result of the county officer receiving an
14 award or stipend payable from State funds.
15 (f) The compensation, necessary clerk hire, stationery,
16 fuel and other expenses of the county auditor, as fixed by
17 the county board, shall be paid by the county.
18 (g) The population of all counties for the purpose of
19 fixing compensation, as herein provided, shall be based upon
20 the last Federal census immediately previous to the election
21 of the officer in question in each county.

24 Sec. 4-6002. Coroners in counties of less than 2,000,000.
25 (a) The County Board, in all counties of less than
26 2,000,000 inhabitants, shall fix the compensation of Coroners
27 within the limitations fixed by this Division, and shall
28 appropriate for their necessary clerk hire, stationery, fuel,
29 supplies, and other expenses. The compensation of the Coroner
30 shall be fixed separately from his necessary clerk hire,
31 stationery, fuel and other expenses, and such compensation
32 shall be fixed within the following limits:
33 To each Coroner in counties containing less than 5,000

1 inhabitants, not less than $4,500 per annum.
2 To each Coroner in counties containing 5,000 or more
3 inhabitants but less than 14,000 inhabitants, not less than
4 $6,000 per annum.
5 To each Coroner in counties containing 14,000 or more
6 inhabitants, but less than 30,000 inhabitants, not less than
7 $9,000 per annum.
8 To each Coroner in counties containing 30,000 or more
9 inhabitants, but less than 60,000 inhabitants, not less than
10 $14,000 per annum.
11 To each Coroner in counties containing 60,000 or more
12 inhabitants, but less than 100,000 inhabitants, not less than
13 $15,000 per annum.
14 To each Coroner in counties containing 100,000 or more
15 inhabitants, but less than 200,000 inhabitants, not less than
16 $16,500 per annum.
17 To each Coroner in counties containing 200,000 or more
18 inhabitants, but less than 300,000 inhabitants, not less than
19 $18,000 per annum.
20 To each Coroner in counties containing 300,000 or more
21 inhabitants, but less than 2,000,000 inhabitants, not less
22 than $20,000 per annum.
23 The population of all counties for the purpose of fixing
24 compensation, as herein provided, shall be based upon the
25 last Federal census immediately previous to the election of
26 the Coroner in question in each county. This Section does not
27 apply to a county which has abolished the elective office of
28 coroner.
29 (b) Those coroners beginning a term of office on or
30 after December 1, 1990 shall be compensated as follows:
31 (1) Beginning December 1, 1990, base salary plus at
32 least 3% of base salary.
33 (2) Beginning December 1, 1991, base salary plus at
34 least 6% of base salary.

1 (3) Beginning December 1, 1992, base salary plus at
2 least 9% of base salary.
3 (4) Beginning December 1, 1993, base salary plus at
4 least 12% of base salary.
5 "Base salary", as used in this subsection (b), means the
6 salary in effect before July 1, 1989.
7 (c) In addition to, but separate and apart from, the
8 compensation provided in this Section, the coroner of each
9 county shall receive an annual stipend of $6,500 to be paid
10 by the State if his or her term begins on or after December
11 1, 2000.
12 Notwithstanding any other provision to the contrary, upon
13 the expiration of the term of the county coroner of each
14 county in office at the time of the effective date of this
15 amendatory Act of the 93rd General Assembly, no awards shall
16 be appropriated by the General Assembly for the purposes of
17 this subsection and no awards shall be paid under the
18 provisions of this subsection to the county coroner of each
19 county.

22 Sec. 4-6003. Compensation of sheriffs for certain
23 expenses in counties of less than 2,000,000.
24 (a) The County Board, in all counties of less than
25 2,000,000 inhabitants, shall fix the compensation of
26 sheriffs, with the amount of their necessary clerk hire,
27 stationery, fuel and other expenses. The county shall supply
28 the sheriff with all necessary uniforms, guns and ammunition.
29 The compensation of each such officer shall be fixed
30 separately from his necessary clerk hire, stationery, fuel
31 and other expenses. Beginning immediately, no county with a
32 population under 2,000,000 may reduce the rate of
33 compensation of its sheriff below the rate of compensation

1 that it was actually paying to its sheriff on January 1, 2002
2 or the effective date of this amendatory Act of the 92nd
3 General Assembly, whichever is greater.
4 (b) In addition to the requirement of subsection (a),
5 the rate of compensation payable to the sheriff by the county
6 shall not be less than the following:
7 To each such sheriff in counties containing less than
8 10,000 inhabitants, not less than $27,000 per annum.
9 To each such sheriff in counties containing 10,000 or
10 more inhabitants but less than 20,000 inhabitants, not less
11 than $31,000 per annum.
12 To each such sheriff in counties containing 20,000 or
13 more inhabitants but less than 30,000 inhabitants, not less
14 than $34,000 per annum.
15 To each such sheriff in counties containing 30,000 or
16 more inhabitants but less than 60,000 inhabitants, not less
17 than $37,000 per annum.
18 To each such sheriff in counties containing 60,000 or
19 more inhabitants but less than 100,000 inhabitants, not less
20 than $40,000 per annum.
21 To each such sheriff in counties containing 100,000 or
22 more inhabitants but less than 2,000,000 inhabitants, not
23 less than $43,000 per annum.
24 The population of each county for the purpose of fixing
25 compensation as herein provided, shall be based upon the last
26 federal census immediately previous to the election of the
27 sheriff in question in such county.
28 (c) (Blank).
29 (d) In addition to the salary provided for in
30 subsections (a), (b), and (c), beginning December 1, 1998,
31 each sheriff, for his or her additional duties imposed by
32 other statutes or laws, shall receive an annual stipend to be
33 paid by the State in the amount of $6,500.
34 Notwithstanding any other provision to the contrary, upon

1 the expiration of the term of the county sheriff of each
2 county in office at the time of the effective date of this
3 amendatory Act of the 93rd General Assembly, no awards shall
4 be appropriated by the General Assembly for the purposes of
5 this subsection and no awards shall be paid under the
6 provisions of this subsection to the county sheriff of each
7 county.
8 (e) No county board may reduce or otherwise impair the
9 compensation payable from county funds to a sheriff if the
10 reduction or impairment is the result of the sheriff
11 receiving an award or stipend payable from State funds.

14 Sec. 4-8002. Additional compensation of sheriff and
15 recorder.
16 (a) In addition to any salary otherwise provided by law,
17 beginning December 1, 1998, the sheriff of Cook County for
18 his or her additional duties imposed by other statutes or
19 laws shall receive an annual stipend to be paid by the State
20 in the amount of $6,500. The county board shall not reduce
21 or otherwise impair the compensation payable from county
22 funds to the sheriff if the reduction or impairment is the
23 result of the sheriff receiving a stipend payable from State
24 funds.
25 Notwithstanding any other provision to the contrary, upon
26 the expiration of the term of the sheriff of Cook County in
27 office at the time of the effective date of this amendatory
28 Act of the 93rd General Assembly, no awards shall be
29 appropriated by the General Assembly for the purposes of this
30 subsection and no awards shall be paid under the provisions
31 of this subsection to the sheriff of Cook County.
32 (b) In addition to any salary otherwise provided by law,
33 beginning December 1, 2000, the recorder of deeds of Cook

1 County for his or her additional duties imposed by law shall
2 receive an annual stipend to be paid by the State in an
3 amount equal to the stipend paid to each recorder in other
4 counties under subsection (d) of Section 4-6001 of this Code.
5 The county board may not reduce or otherwise impair the
6 compensation payable from county funds to the recorder of
7 deeds if the reduction or impairment is the result of the
8 recorder of deeds receiving a stipend payable from State
9 funds.
10 Notwithstanding any provision to the contrary, upon the
11 expiration of the term of the recorder of deeds of Cook
12 County in office at the time of the effective date of this
13 amendatory Act of the 93rd General Assembly, no awards shall
14 be appropriated by the General Assembly for the purposes of
15 this subsection and no awards shall be paid under the
16 provisions of this subsection to the recorder of deeds of
17 Cook County.
