Amends the Public Building Commission Act. Provides that a county board is not required to receive referendum approval to expand the purpose of a public building commission to include acquiring, enlarging, improving, repairing, replacing, or constructing a statutorily required government facility, including but not limited to, a courthouse.

| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Public Building Commission Act is amended by | 5 | | changing Section 4a as follows:
| 6 | | (50 ILCS 20/4a) (from Ch. 85, par. 1034a)
| 7 | | Sec. 4a. A Public Building Commission may be created for | 8 | | the limited
purpose of constructing, acquiring, enlarging, | 9 | | improving, repairing or
replacing
a specific public | 10 | | improvement, building or facility or a special type or
class of | 11 | | public improvements, buildings or facilities. The provisions | 12 | | of
Section 4 of this Act shall apply to the creation of a | 13 | | Public Building
Commission
under this Section, except that the | 14 | | resolution adopted by the municipality
or county board and the | 15 | | proposition shall specify the limited purpose for
which such | 16 | | Public Building Commission is to be created. The provisions of
| 17 | | Section 4 authorizing any municipal corporation any part of | 18 | | whose area of
jurisdiction lies within the territorial limits | 19 | | of that county seat to join
in the organization of the Public | 20 | | Building Commission in the manner set
forth in that Section | 21 | | shall not be applicable to a Public Building Commission
created | 22 | | under this Section. The county board of any county that has | 23 | | created a public building commission for a limited and specific |

| 1 | | purpose may expand that purpose by resolution.
| 2 | | The purpose of a public building commission created by the | 3 | | county board of any county may not be expanded until the | 4 | | question of expanding the purpose of the public building | 5 | | commission has been submitted to the electors of the county at | 6 | | a regular election and approved by a majority of the electors | 7 | | voting on the question. The county board must certify the | 8 | | question to the proper election authority, which must submit | 9 | | the question at an election in accordance with the Election | 10 | | Code. | 11 | | The election authority must submit the question in | 12 | | substantially the following form: | 13 | | Shall the county board be authorized to expand the | 14 | | purpose of the (insert name of public building commission) | 15 | | to include (insert the purpose or purposes)? | 16 | | The election authority must record the votes as "Yes" or | 17 | | "No". | 18 | | If a majority of the electors voting on the question vote | 19 | | in the affirmative, the county board may thereafter expand the | 20 | | purpose of the public building commission.
| 21 | | Notwithstanding any provision of this Section to the | 22 | | contrary, a county board is not required to receive referendum | 23 | | approval to expand the purpose of a public building commission | 24 | | to include acquiring, enlarging, improving, repairing, | 25 | | replacing, or constructing a statutorily required government | 26 | | facility, including but not limited to, a courthouse. |
