Amends the Disaster Service Volunteer Leave Act and the Local Government Disaster Service Volunteer Act. Provides that an employee of a State
or local agency who is a member of a Community Emergency Response Team created under the direction of a unit of local government, or any agency thereof, may be granted
leave from his or her work with pay for not more than 20 working
days in any 12-month period to participate in specialized disaster relief
services upon the request of Illinois Emergency Management Agency for the services of that
employee and upon
the approval of that
employee's agency, without loss of seniority, pay, vacation time,
compensatory time, personal days, sick time or earned overtime
accumulation. Effective immediately.

| AN ACT concerning public employees.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Disaster Service Volunteer Leave Act is | 5 |
| amended by changing Section 3 as follows: | 6 |
| (5 ILCS 335/3) (from Ch. 127, par. 4053)

| Sec. 3. Disaster Service Volunteer Leave. | 8 |
| (a) An employee of a State
agency who is a certified | 9 |
| disaster service volunteer of the American Red
Cross or | 10 |
| assigned to the Illinois Emergency Management Agency in | 11 |
| accordance
with the Illinois Emergency Management Agency Act, | 12 |
| the Emergency Management Assistance
Compact Act, or other | 13 |
| applicable administrative rules may be granted
leave from his | 14 |
| work with pay for not more than 20 working
days in any 12-month | 15 |
| period to participate in specialized disaster relief
services | 16 |
| for the American Red Cross or for the Illinois Emergency | 17 |
| Management
Agency, as the case may
be, upon the request of the | 18 |
| American Red
Cross or the Illinois Emergency Management Agency | 19 |
| for the services of that
employee and upon
the approval of that
| 20 |
| employee's agency, without loss of seniority, pay, vacation | 21 |

| (c) The agency shall compensate an employee granted leave | 2 |
| under
this Section at his regular rate of pay for those regular | 3 |
| work hours during
which the employee is absent from his work.
| 4 |
| For purposes of assessing State disaster response needs, | 5 |
| requests made
pursuant to this Act for services out-of-state | 6 |
| shall be coordinated by the
American Red Cross and the Illinois | 7 |
| Emergency Management Agency through the
Illinois State | 8 |
| Emergency Operations Center. The Illinois Emergency Management
| 9 |
| Agency may consult with the Department of Central Management | 10 |
| Services on leave
issues that could impact the operations of | 11 |
| State agencies under the Governor's
jurisdiction. Leave under | 12 |
| this Act shall not
be unreasonably denied for services related | 13 |
| to a disaster within the United
States or its territories.

| Section 10. The Local Government Disaster Service | 16 |
| Volunteer Act is amended by changing Section 15 as follows: | 17 |

| (a) An employee of
