 1        AN ACT concerning public contracts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title. This Act may  be  cited  as  the
 5    Public Works Subcontractor Responsibility Act.

 6        Section    5.  Applicability.   This   Act   applies   to
 7    subcontracts for public works contracts entered into  by  the
 8    State,  by  a  unit  of  local  government,  or  by  a school
 9    district.

10        Section 10.  Minority and female goals.  Each subcontract
11    for a public works contract must include a provision  setting
12    forth  the percentage of female and minority workers that the
13    subcontractor plans to employ to perform work on  the  public
14    works project. This provision should, but is not required to,
15    stress the importance of hiring the percentage of females and
16    minorities that is set out in the contract.

17        Section  15.  Penalties.  If  any  subcontractor fails to
18    employ the percentage of females and minorities on  a  public
19    works  project  as  set  forth  in  the subcontract, then the
20    subcontractor must pay a penalty in the amount of  the  price
21    of  the  subcontract  multiplied by the percentage of females
22    and minorities that the subcontractor planned to employ.  The
23    penalty shall be paid to the governmental entity that entered
24    into  the  public works project. The contractor is not liable
25    for any violation of this Act.

26        Section 20. Home rule. A home rule unit may not  regulate
27    its  public  works contracts in a manner that is inconsistent
28    with the provisions of this Act. This Section is a limitation

 2    Article VII of the Illinois Constituion.
