 1                    AMENDMENT TO HOUSE BILL 2277

 2        AMENDMENT NO.     .  Amend House Bill 2277  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Public Community College Act is amended
 5    by changing Section 3-7 as follows:

 6        (110 ILCS 805/3-7) (from Ch. 122, par. 103-7)
 7        Sec. 3-7.  (a) The election of the members of  the  board
 8    of  trustees  shall  be  nonpartisan and shall be held at the
 9    time and in the manner provided in the general election law.
10        (b)  Unless otherwise provided in this Act, members shall
11    be elected to serve  6  year  terms.   The  term  of  members
12    elected  in  1985  and  thereafter shall be from the date the
13    member is officially determined to be elected to the board by
14    a canvass conducted pursuant to the  Election  Code,  to  the
15    date  that the winner of the seat is officially determined by
16    the canvass conducted pursuant to the Election Code the  next
17    time the seat on the board is to be filled by election.
18        (c)  A  board of trustees of a community college district
19    which is contiguous or has been contiguous to an experimental
20    community college  district  as  authorized  and  defined  by
21    Article IV of this Act may, on its own motion, or shall, upon
22    the  petition  of  the  lesser of 1/10 or 2,000 of the voters

 1    registered in the district, order submitted to the voters  of
 2    the district at the next general election the proposition for
 3    the election of board members by trustee district rather than
 4    at  large,  and such proposition shall thereupon be certified
 5    by  the  secretary  of  the  board  to  the  proper  election
 6    authority in accordance with the  general  election  law  for
 7    submission.
 8        If  the  proposition  is  approved by a majority of those
 9    voting on the proposition, the State Board of  Elections,  in
10    1991,  shall reapportion the trustee districts to reflect the
11    results of the last decennial census, and  shall  divide  the
12    community  college district into 7 trustee districts, each of
13    which shall be compact, contiguous and substantially equal in
14    population to each other district.  In 2001, and in the  year
15    following  each  decennial  census  thereafter,  the board of
16    trustees of community college District #522 shall reapportion
17    the trustee districts to reflect the results of  the  census,
18    and  shall  divide  the  community  college  district  into 7
19    trustee  districts,  each  of   which   shall   be   compact,
20    contiguous,  and  substantially  equal  in population to each
21    other  district.   The  division  of  the  community  college
22    district  into  trustee  districts  shall  be  completed  and
23    formally approved by a majority of the members of  the  board
24    of trustees of community college District #522 in 2001 and in
25    the  year  following  each  decennial  census.   At  the same
26    meeting of the board of trustees, the board  shall,  publicly
27    by  lot,  divide the trustee districts as equally as possible
28    into  2  groups.  Beginning  in  2003  and  every  10   years
29    thereafter, trustees or their successors from one group shall
30    be  elected  for successive terms of 4 years and 6 years; and
31    members or their successors from the second  group  shall  be
32    elected  for  successive  terms  of 6 years and 4 years.  One
33    member shall be elected  from  each  such  trustee  district.
34    Each  member  elected  in  2001  shall be elected at the 2001

 1    consolidated election from the trustee districts  established
 2    in  1991.   The term of each member elected in 2001 shall end
 3    on the date that the trustees elected in 2003 are  officially
 4    determined  by  a  canvass conducted pursuant to the Election
 5    Code.
 6        (d)  In Community College District No. 526, the  election
 7    of  board members shall be by trustee district rather than at
 8    large beginning with the consolidated election in 2005.
 9        For the 2005, 2007, and 2009 consolidated elections,  the
10    board  shall  divide  the  community  college district into 7
11    trustee  districts,  each  of   which   shall   be   compact,
12    contiguous,  and  substantially  equal  in population to each
13    other trustee district based  on  the  results  of  the  2000
14    decennial  census,  with consideration being given to keeping
15    existing school district boundaries intact. The  division  of
16    the  community  college district into trustee districts shall
17    be completed and formally  approved  by  a  majority  of  the
18    members  of  the  board  in  2003.  If  the  division  of the
19    community college district  into  trustee  districts  is  not
20    completed  and  formally  approved  on or before December 31,
21    2003, then the  Supreme  Court  shall  divide  the  community
22    college  district  into  trustee districts. For each at-large
23    seat on the board that is to be filled by election in 2005 or
24    2007, the seat shall be filled by a trustee  elected  from  a
25    trustee  district.  The  board  shall determine which trustee
26    district seat is to replace which at-large seat by  lot.  The
27    term of each trustee elected at the 2005 or 2007 consolidated
28    election  shall  end on the date that the trustees elected in
29    2009  are  officially  determined  by  a  canvass   conducted
30    pursuant  to  the  Election  Code.  For the 2009 consolidated
31    election, one trustee shall  be  elected  from  each  trustee
32    district to serve a 4-year term.
33        In  2011, and in the year following each decennial census
34    thereafter, the board shall reapportion the trustee districts

 1    to reflect the results of the census  and  shall  divide  the
 2    community  college district into 7 trustee districts, each of
 3    which shall be compact, contiguous, and  substantially  equal
 4    in   population   to   each   other  trustee  district,  with
 5    consideration being given to keeping existing school district
 6    boundaries intact. One trustee shall  then  be  elected  from
 7    each  trustee district. The division of the community college
 8    district  into  trustee  districts  shall  be  completed  and
 9    formally approved by a majority of the members of  the  board
10    in  2011  and in the year following each decennial census. At
11    the same meeting of the board, the board shall,  publicly  by
12    lot, divide the trustee districts as equally as possible into
13    3  groups.  Beginning with the 2013 consolidated election and
14    the consolidated election every 10 years thereafter, trustees
15    or their successors from the first group shall be elected for
16    successive terms of 2 years, 4 years, and 4  years;  trustees
17    or  their  successors  from the second group shall be elected
18    for successive terms of 4 years, 2 years, and  4  years;  and
19    trustees  or  their  successors from the third group shall be
20    elected for successive terms of  4  years,  4  years,  and  2
21    years. If the division of the community college district into
22    trustee  districts  is not completed and formally approved on
23    or before December 31 of the  year  following  the  decennial
24    census,  then  the  Supreme  Court shall divide the community
25    college district into trustee districts.
26        (e)  Each member must on the date of his  election  be  a
27    citizen of the United States, of the age of 18 years or over,
28    and  a  resident  of the State and the territory which on the
29    date of the election is included  in  the  community  college
30    district  for  at  least  one  year immediately preceding his
31    election. In Community College District No. 526, each  member
32    elected  at  the  consolidated election in 2005 or thereafter
33    must also be a resident of the trustee  district  he  or  she
34    represents for at least one year immediately preceding his or

 1    her  election.    In  the event a person who is a member of a
 2    common school board is elected or appointed  to  a  board  of
 3    trustees  of  a community college district, that person shall
 4    be permitted to serve the remainder of his  or  her  term  of
 5    office  as  a  member  of  the  common school board. Upon the
 6    expiration of the common school board term, that person shall
 7    not be eligible for  election  or  appointment  to  a  common
 8    school  board  during  the  term of office with the community
 9    college district board of trustees.
10        (f)  Whenever a vacancy  occurs,  the  remaining  members
11    shall  fill  the  vacancy,  and the person so appointed shall
12    serve until a  successor  is  elected  at  the  next  regular
13    election  for  board  members  and is certified in accordance
14    with Sections 22-17 and 22-18 of the Election Code.   If  the
15    remaining  members  fail  so  to act within 60 days after the
16    vacancy occurs, the chairman of the State  Board  shall  fill
17    that vacancy, and the person so appointed shall serve until a
18    successor  is  elected at the next regular election for board
19    members and is certified in accordance  with  Sections  22-17
20    and 22-18 of the Election Code.  The person appointed to fill
21    the vacancy shall have the same residential qualifications as
22    his  predecessor  in  office  was required to have. In either
23    instance, if the vacancy  occurs  with  less  than  4  months
24    remaining  before  the  next scheduled consolidated election,
25    and the term of office  of  the  board  member  vacating  the
26    position  is  not  scheduled to expire at that election, then
27    the term of the person so appointed shall extend through that
28    election and until the succeeding consolidated election.   If
29    the  term of office of the board member vacating the position
30    is scheduled to expire at the upcoming consolidated election,
31    the appointed member shall serve only until  a  successor  is
32    elected and qualified at that election.
33        (g)  Members   of   the   board   shall   serve   without
34    compensation  but  shall  be  reimbursed for their reasonable

 1    expenses  incurred  in  connection  with  their  service   as
 2    members.  Compensation,  for  purposes of this Section, means
 3    any salary or other benefits not expressly authorized by this
 4    Act to be provided or paid to, for or on behalf of members of
 5    the board.  The board of each community college district  may
 6    adopt  a  policy  providing  for  the issuance of bank credit
 7    cards, for use by any board member who requests the  same  in
 8    writing  and  agrees  to use the card only for the reasonable
 9    expenses which he or she incurs in connection with his or her
10    service as a board member.  Expenses charged to  such  credit
11    cards   shall  be  accounted  for  separately  and  shall  be
12    submitted to the chief financial officer of the district  for
13    review  prior  to  being  reported  to  the board at its next
14    regular meeting.
15        (h)  Except in an election of the initial board for a new
16    community college district created pursuant to Section 6-6.1,
17    the ballot for the election of members of  the  board  for  a
18    community  college district shall indicate the length of term
19    for each office to be filled.  In the election of a board for
20    any community college district, the ballot shall not  contain
21    any political party designation.
