 1        AN ACT in relation to vehicles.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 5    changing Section 6-107.1 as follows:

 6        (625 ILCS 5/6-107.1)
 7        Sec. 6-107.1.  Instruction permit for a minor.
 8        (a)  The   Secretary  of  State,  upon  receiving  proper
 9    application and payment of the required  fee,  may  issue  an
10    instruction  permit  to  any person under the age of 18 years
11    who is not ineligible for a license under paragraphs 1, 3, 4,
12    5, 7,  or  8  of  Section  6-103,  after  the  applicant  has
13    successfully  passed  such  examination  as  the Secretary of
14    State in his discretion may prescribe.
15             (1)  An instruction permit issued under this Section
16        shall be valid for a period of 24 months after  the  date
17        of its issuance and shall be restricted, by the Secretary
18        of  State,  to  the  operation  of a motor vehicle by the
19        minor only when accompanied by the adult instructor of  a
20        driver education program during enrollment in the program
21        or  when practicing with a parent, legal guardian, family
22        member, or a person in loco parentis who is 21  years  of
23        age or more, has a license classification to operate such
24        vehicle  and at least one year of driving experience, and
25        who is occupying a seat beside the driver.
26             (2)  A 24  month  instruction  permit  for  a  motor
27        driven  cycle may be issued to a person 16 or 17 years of
28        age and entitles the holder to drive  upon  the  highways
29        during  daylight  under  direct supervision of a licensed
30        motor driven cycle operator  or  motorcycle  operator  21
31        years of age or older who has a license classification to

 1        operate  such  motor  driven  cycle  or motorcycle and at
 2        least one year of driving experience.
 3             (3)  A 24 month instruction permit for a  motorcycle
 4        other than a motor driven cycle may be issued to a person
 5        16  or 17 years of age in accordance with the  provisions
 6        of paragraph 2 of Section 6-103 and entitles a holder  to
 7        drive  upon the highways during daylight under the direct
 8        supervision of a licensed motorcycle operator 21 years of
 9        age or older  who  has  at  least  one  year  of  driving
10        experience.
11             (4)  When  issuing  an instruction permit under this
12        Section, the Secretary of State shall also issue  to  the
13        applicant a sign or signs with the words "Student Driver"
14        printed  on  it.  The  Secretary  shall  adopt  rules for
15        implementing this paragraph (4).
16        (a-1)  The sign or signs issued under this  Section  must
17    be  displayed  on  the  vehicle, and must be visible from the
18    front and the rear, whenever the holder  of  the  instruction
19    permit is driving.
20        (b)  An instruction permit issued under this Section when
21    issued  to  a  person  under  the age of 17 years shall, as a
22    matter of law, be invalid for  the  operation  of  any  motor
23    vehicle  during  the  same  time the child is prohibited from
24    being on any street or highway under the  provisions  of  the
25    Child Curfew Act.
26        (c)  Any  person  under the age of 16 years who possesses
27    an instruction permit and whose driving privileges have  been
28    suspended  or revoked under the provisions of this Code shall
29    not be granted  a  Family  Financial  Responsibility  Driving
30    Permit or a Restricted Driving Permit.
