SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.23e new

    Amends the Environmental Protection Act. Provides that, beginning January 1, 2026, no person may knowingly cause or allow the mixing of a photovoltaic module with municipal waste that is intended for disposal at a landfill. Provides that, beginning January 1, 2026, no person may knowingly cause or allow the disposal of a photovoltaic module in a sanitary landfill. Defines "consumer electronic device" and "photovoltaic module". Effective January 1, 2025.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 22.23e as follows:
 
6    (415 ILCS 5/22.23e new)
7    Sec. 22.23e. Photovoltaic modules.
8    (a) As used in this Section:
9    "Consumer electronic device" means any device containing
10an electronic circuit board that is intended for everyday use
11by individuals.
12    "Photovoltaic module" means the smallest, nondivisible,
13environmentally protected assembly of photovoltaic cells or
14other photovoltaic collector technology, and any ancillary
15part, intended to generate electrical power under sunlight.
16"Photovoltaic module" does not include a photovoltaic cell
17that is part of a consumer electronic device for which it
18provides electricity needed to make the consumer electronic
19device function. "Photovoltaic module" includes, but is not
20limited to, interconnections, terminals, and protective
21devices, such as diodes, that are:
22        (1) installed on, connected to, or integral to
23    buildings;

1        (2) used as components of freestanding, off-grid power
2    generation systems, such as for powering water pumping
3    stations, electric vehicle charging stations, fencing,
4    street and signage lights, and other commercial or
5    agricultural purposes; or
6        (3) part of a system connected to a grid or utility
7    service.
8    (b) Beginning January 1, 2026, no person may knowingly
9cause or allow the mixing of a photovoltaic module with
10municipal waste that is intended for disposal at a landfill.
11    (c) Beginning January 1, 2026, no person may knowingly
12cause or allow the disposal of a photovoltaic module in a
13sanitary landfill.
 
14    Section 99. Effective date. This Act takes effect January
151, 2025.
