SYNOPSIS AS INTRODUCED:
 
625 ILCS 57/27 new
815 ILCS 505/2EEEE new

    Amends the Transportation Network Providers Act. Provides that no transportation network company (TNC) driver, after having accepted a request through the TNC's digital network or software application and having picked up the passenger, shall demand, force, or otherwise require the passenger to exit the vehicle prior to arriving at the destination, unless actions of the passenger have caused the driver to reasonably fear for the driver's health or safety. Provides that if a TNC driver forces a passenger to prematurely exit the vehicle, the TNC that the TNC driver is providing services for shall be assessed a fine of $500, and the TNC shall credit the passenger for the amount of the ride that was prematurely ended. Provides that fines shall be enforced and collected by the Consumer Protection Division of the Office of the Attorney General. Provides that the Attorney General shall have the powers to enforce the provisions as set forth in specified provisions of the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make conforming changes.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Transportation Network Providers Act is
5amended by adding Section 27 as follows:
 
6    (625 ILCS 57/27 new)
7    Sec. 27. Fines for forcing passengers to exit vehicles.
8    (a) No TNC driver, after having accepted a request through
9the TNC's digital network or software application and having
10picked up the passenger, shall demand, force, or otherwise
11require the passenger to exit the vehicle prior to arriving at
12the destination, unless actions of the passenger have caused
13the driver to reasonably fear for the driver's health or
14safety.
15    (b) If a TNC driver forces a passenger to prematurely exit
16the vehicle for any reason except for those stated in
17subsection (a), the TNC that the TNC driver is providing
18services for shall be assessed a fine of $500, and the TNC
19shall credit the passenger for the amount of the ride that was
20prematurely ended.
21    (c) Fines under this Section shall be enforced and
22collected by the Consumer Protection Division of the Office of
23the Attorney General.

1    (d) The Attorney General shall have the powers to enforce
2this Section as set forth in Sections 3, 4, 5, and 6 of the
3Consumer Fraud and Deceptive Business Practices Act.
 
4    Section 10. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2EEEE as follows:
 
6    (815 ILCS 505/2EEEE new)
7    Sec. 2EEEE. Transportation Network Providers Act
8violations. It is an unlawful practice under this Act to
9violate Section 27 of the Transportation Network Providers
10Act.
