1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Protection District Act is amended by
5adding Section 15e as follows:
 
6    (70 ILCS 705/15e new)
7    Sec. 15e. Dissolution of Elk Grove Rural Fire Protection
8District.
9    (a) The Elk Grove Rural Fire Protection District shall be
10dissolved by operation of law effective immediately upon the
11occurrence of all the conditions set forth in subsection (c).
12    (b) The president of the board of trustees of the Elk Grove
13Rural Fire Protection District serving on October 1, 2023 and
14the mayor of the Village of Mount Prospect are hereby
15appointed and authorized to close up the business affairs of
16the Elk Grove Rural Fire Protection District, including by
17performing, or causing to be performed, all activities
18necessary to cause the conditions set forth in subsection (c)
19to be satisfied. The president of the board of trustees of the
20Elk Grove Rural Fire Protection District serving on October 1,
212023 and the mayor of the Village of Mount Prospect shall
22unanimously approve all actions taken by them in connection
23with the closing up of the business affairs of the Elk Grove

1Rural Fire Protection District.
2    (c) After all the following conditions have been
3satisfied, the dissolution of the Elk Grove Rural Fire
4Protection District shall become effective immediately:
5        (1) the payment of all outstanding liabilities of the
6    Elk Grove Rural Fire Protection District;
7        (2) the conveyance of title of all of the Elk Grove
8    Rural Fire Protection District's remaining real and
9    personal property to the Village of Mount Prospect in
10    accordance with the agreement entered into between the Elk
11    Grove Rural Fire Protection District, the Village of Mount
12    Prospect, and Elk Grove Township; and
13        (3) the submittal to, and approval by resolution
14    adopted by, the Cook County Board of Commissioners of an
15    accounting showing that all known outstanding liabilities
16    of the Elk Grove Fire Protection District have been paid
17    and title of all of the Elk Grove Rural Fire Protection
18    District's known real and personal property has been
19    conveyed to the Village of Mount Prospect.
20        After the Cook County Board of Commissioners passes a
21    resolution approving the accounting described in this
22    paragraph (3), title of any remaining money of the Elk
23    Grove Rural Fire Protection District shall, by operation
24    of law, be transferred to the Village of Mount Prospect in
25    accordance with the agreement entered into between the Elk
26    Grove Rural Fire Protection District, the Village of Mount

1    Prospect, and Elk Grove Township.
2    Any bank or other financial institution at which the Elk
3Grove Rural Fire Protection District has accounts is
4authorized, upon presentment of a certified copy of the
5resolution passed by the Cook County Board of Commissioners
6approving the accounting described in paragraph (3), to
7transfer the funds in the Elk Grove Rural Fire Protection
8District's accounts to the Village of Mount Prospect.
9    (d) Notwithstanding the requirements of Section 27-5 of
10the Property Tax Code, the Special Service Area created by the
11Village of Mount Prospect and approved by Cook County in order
12to take the place of the Elk Grove Rural Fire Protection
13District's tax levy after dissolution shall not require
14geographical contiguity.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
