SYNOPSIS AS INTRODUCED:
 
35 ILCS 517/15 new

    Amends the Manufactured Home Installation Act. Provides that a unit of local government may not regulate or restrict the use, occupancy, movement, or relocation of mobile homes or manufactured homes based upon the age of the mobile home or manufactured home. Preempts the concurrent exercise of home rule powers.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Manufactured Home Installation Act is
5amended by adding Section 15 as follows:
 
6    (35 ILCS 517/15 new)
7    Sec. 15. Regulation of mobile homes or manufactured homes
8based on age prohibited. A unit of local government may not
9regulate or restrict the use, occupancy, movement, or
10relocation of mobile homes or manufactured homes, as defined
11in Section 10 of the Manufactured Home Quality Assurance Act,
12based upon the age of the mobile home or manufactured home. A
13home rule unit may not exercise its home rule powers and
14functions in a manner that is inconsistent with this Section.
15This Section is a limitation under subsection (i) of Section 6
16of Article VII of the Illinois Constitution on the concurrent
17exercise by home rule units of powers and functions exercised
18by the State.
