SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/1A-16.10 new
10 ILCS 5/3-6

    Amends the Election Code. Provides that notwithstanding any other provision of law, a person who is age 16 or over, does not meet the voting age requirements under specified provisions of the Code, and is otherwise qualified to vote shall be preregistered to vote when the person applies for a driver's license at a Secretary of State Driver Services facility, unless the person opts out of the preregistration. Provides that the Secretary of State shall transmit to the State Board of Elections the information necessary for the State Board of Elections to register the person to vote once the person meets the voting age requirements specified in the Code. Provides that the person must be given the option to opt out of the preregistration. Provides that notwithstanding any other provision of law, a person who is otherwise qualified to vote may preregister to vote on or after that person's 16th birthday. Provides that for the purposes of the Code, an individual who is 16 years of age or older (rather than who is 17 years of age and who will be 18 years of age on the date of the general or consolidated election) shall be deemed competent to execute and attest to any voter registration forms.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
53-6 and by adding Section 1A-16.10 as follows:
 
6    (10 ILCS 5/1A-16.10 new)
7    Sec. 1A-16.10. Automatic voter preregistration.
8Notwithstanding any other provision of law, a person who is age
916 or over, does not meet the voting age requirements of
10Section 3-6, and is otherwise qualified to vote shall be
11preregistered to vote when the person applies for a driver's
12license at a Secretary of State Driver Services facility,
13unless the person opts out of the preregistration. The
14Secretary of State shall transmit to the State Board of
15Elections the information necessary for the State Board of
16Elections to register the person to vote once the person meets
17the voting age requirements under Section 3-6. The person must
18be given the option to opt out of preregistration under this
19Section.

21    Sec. 3-6. Voting and registration age.

1otherwise qualified to vote may preregister to vote on or after
2that person's 16th birthday in accordance with Section
31A-16.10.
4    Notwithstanding any other provision of law, a person who is
517 years old on the date of a caucus, general primary election,
6or consolidated primary election and who is otherwise qualified
7to vote is qualified to vote at that caucus, general primary,
8or consolidated primary, including voting a vote by mail, grace
9period, or early voting ballot with respect to that general
10primary or consolidated primary, if that person will be 18
11years old on the date of the immediately following general
12election or consolidated election for which candidates are
13nominated at that primary.
14    For the purposes of this Code, a person who is 16 years of
15age or older shall be deemed competent to execute and attest to
16any voter registration forms.
17    References in this Code and elsewhere to the requirement
18that a person must be 18 years old to vote shall be interpreted
19in accordance with this Section.
20    For the purposes of this Code, an individual who is 17
21years of age and who will be 18 years of age on the date of the
22general or consolidated election shall be deemed competent to
23execute and attest to any voter registration forms. An
24individual who is 17 years of age, will be 18 years of age on
25the date of the immediately following general or consolidated
26election, and is otherwise qualified to vote shall be deemed

1eligible to circulate a nominating petition or a petition
2proposing a public question.
