SYNOPSIS AS INTRODUCED:
 
70 ILCS 1205/4-7  from Ch. 105, par. 4-7
70 ILCS 1325/1  from Ch. 105, par. 330a

    Amends the Park District Code and the Park District Police Act. Provides that the jurisdiction of the police officers of a park district is anywhere within the boundaries of the district (rather than within the parks, boulevards, driveways, and property controlled by the park district). Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 4-7 as follows:
 
6    (70 ILCS 1205/4-7)  (from Ch. 105, par. 4-7)
7    Sec. 4-7. Employees; police force. The board of any park
8district may employ engineers, attorneys, clerks and other
9employees, including a police force, as may be required, and
10may define and prescribe their respective duties and
11compensation. After receiving a certificate attesting to the
12successful completion of a training course administered by the
13Illinois Law Enforcement Training Standards Board, the members
14of the board and all police officers appointed by the board
15shall be conservators of the peace within the boundaries of and
16upon the parks, boulevards, driveways, and property controlled
17by that park district, and shall have power to make arrests
18subject to the provisions of the Park District Police Act. The
19exercise of such authority shall not permit the possession or
20use of firearms by members of the board.

1changing Section 1 as follows:
 
2    (70 ILCS 1325/1)  (from Ch. 105, par. 330a)
3    Sec. 1. Park police powers.
4    (a) Whenever any park district establishes a police force
5under Section 4-7 of the Park District Code, each officer of
6that force is vested with police powers, is authorized to act
7as a conservator of the peace within the boundaries of that
8park district, and may arrest or cause to be arrested, with or
9without a warrant, any person who breaks the peace, or who
10violates any ordinance of a city, town, or village, or of the
11park district, or any criminal law of the State. If a park
12district maintains an airport, this authority also extends to
13any violation of a rule or regulation of a governing federal
14agency or any federal, State, or local law relating to that
15operation. The authority granted under this Section is
16expressly limited to the boundaries of that park district
17property and shall not be construed to extend to any other
18jurisdiction except in cases of fresh pursuit or under a
19validly executed intergovernmental cooperation agreement.
20    (b) An arrest may be made by a park police officer without
21a warrant when a criminal offense is committed or attempted in
22his presence, or when a criminal offense has been committed and
23the officer has reasonable ground for believing that the person
24to be arrested has committed it. Any person so arrested shall,
25without unnecessary delay, be taken by the officer before the

1circuit court of the county having jurisdiction, and the
2officer shall file a complaint in writing under oath, charging
3the defendant with a violation of a statute or ordinance.
4    (c) A full or part-time police officer employed under this
5Section shall comply with the requirements of the Illinois
6Police Training Act. In addition, before carrying a firearm,
7each officer shall complete a training course under the Peace
8Officer and Probation Officer Firearm Training Act.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
