SYNOPSIS AS INTRODUCED:

105 ILCS 5/34-18.60 new

Amends the Chicago School District Article of the School Code. In cases of potential sexual abuse or sexual assault by a member of school personnel, prohibits an employee of the school district from conducting a formal investigation or interview of a student unless a local law enforcement officer or a sexual abuse or sexual assault specialist is present. Provides that nothing in the provision prohibits a school district employee from conducting informal investigations of possible cases of sexual abuse or sexual assault. Effective immediately.

A BILL FOR

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Section 34-18.60 as follows:

(105 ILCS 5/34-18.60 new)

Sec. 34-18.60. Investigations; sexual abuse or sexual assault. In cases of potential sexual abuse or sexual assault by a member of school personnel, an employee of the school district may not conduct a formal investigation or interview of a student unless a local law enforcement officer or a sexual abuse or sexual assault specialist is present. Nothing in this Section prohibits a school district employee from conducting informal investigations of possible cases of sexual abuse or sexual assault.

Section 99. Effective date. This Act takes effect upon becoming law.
