SYNOPSIS AS INTRODUCED:

    Amends the Toll Highway Act. Provides that the Illinois State Toll Highway Authority shall submit proposed route or routes for additional toll highways with an estimate of the cost to the Governor and the county board of any county the proposed additional toll highway would pass through (rather than only the Governor). Provides that if the estimated cost of the proposed additional toll highway exceeds $1,000,000, then the Authority shall also submit the proposal to the General Assembly for approval. Provides that the Authority shall submit preliminary plans regarding a particular toll highway to the Governor, the General Assembly, and the county board of any county the proposed particular toll highway would pass through (rather than only the Governor) for approval before any bonds are issued. Provides that if the tolls on a proposed toll highway can pay the complete costs, then the Authority shall prepare and submit a preliminary plan only to the Governor for approval.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Toll Highway Act is amended by changing
5Sections 14 and 14.1 as follows:
 
6    (605 ILCS 10/14)  (from Ch. 121, par. 100-14)
7    Sec. 14. Requirements for engineering and traffic studies.
8    (a) The Authority shall, prior to the commencement of any
9engineering and traffic study or studies to determine the
10feasibility of constructing additional toll highways within
11the State of Illinois, submit to the Governor and the county
12board of any county the proposed additional toll highway would
13pass through for his approval, the route, or routes, proposed
14for additional toll highways together with an estimate of the
15cost of the proposed study or studies. If the estimated cost of
16the proposed additional toll highways exceeds $1,000,000, then
17the Authority shall also submit the proposal to the General
18Assembly for approval. If the Governor and the county board or
19boards, and the General Assembly when appropriate, shall
20approve such proposed study or studies and the estimated cost
21thereof, or shall fail to disapprove such proposed study or
22studies and estimate of cost thereof, within 30 days after
23receipt thereof, the Authority may, thereupon, proceed with

1such study or studies.
2    (b) The Authority shall create a local advisory committee
3of members from each county in which any portion of an
4additional toll highway is proposed to be constructed. The
5committee members shall be designated by township and municipal
6governing bodies in proportion to the percentage of corridor
7property situated within the unincorporated area of a township
8and incorporated municipalities located in the same township.
9No less than 50% of the members of this committee shall be
10representatives of organized citizen groups directly affected
11by the proposed corridor. All meetings shall be held in
12compliance with the Open Meetings Act. The committee shall
13consider and advise the Authority with respect to the impact on
14property owners, land use, and other impacts of the proposed
15highway. The committee shall be dissolved when one year has
16elapsed since the opening of the tollway for which the
17committee was created.

20    Sec. 14.1. Requirements for issuance of bonds. The
21Authority shall, prior to the issuance of any bonds under this
22Act, except refunding bonds, prepare and submit to the
23Governor, the General Assembly, and the county board of any
24county the proposed toll highway would pass through for his
25approval preliminary plans showing the proposed location of the

1route or routes of the particular toll highway for which the
2bonds are to be issued, which plans shall designate the
3approximate point of the commencement and the termination of
4said route or routes and shall also designate the
5municipalities to be afforded reasonable connections
6therewith, and to be served thereby. The Authority shall at the
7same time submit to the Governor, the General Assembly, and the
8county board of any county the proposed toll highway would pass
9through for his approval preliminary estimates of the cost of
10the construction of the toll highway, shown on said preliminary
11plans. If the Governor, the General Assembly, and the county
12board or boards shall approve the preliminary plans and the
13estimate of the cost thereof, the Authority may thereupon
14proceed with the issuance of bonds as hereinafter provided. If
15the tolls on the proposed toll highway are projected to pay the
16complete costs of the proposed toll highway, then the Authority
17shall prepare and submit preliminary plans only to the Governor
18for his or her approval. Prior to the issuance of bonds for or
19the commencement of construction of any new toll highway,
20however, that particular toll highway shall be authorized by
21joint resolution of the General Assembly.
