SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/4-210  from Ch. 121, par. 4-210

    Amends the Illinois Highway Code. Provides that the Department of Transportation shall construct a private entrance on Business Route 72, west of Woods Lane, east of State Route 104, on the south side of the road. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Section 4-210 as follows:
 
6    (605 ILCS 5/4-210)  (from Ch. 121, par. 4-210)
7    Sec. 4-210. Except where the right of access has been
8limited by or pursuant to law every owner or occupant of
9property abutting upon any State highway shall have reasonable
10means of ingress from and egress to the State highway
11consistent with the use being made of such property and not
12inconsistent with public safety or with the proper construction
13and maintenance of the State highway for purposes of travel,
14drainage and other appropriate public use. The Department is
15authorized to adopt and to amend reasonable and necessary
16rules, regulations and specifications covering standard
17entrance or exit driveways to serve residential, farm,
18commercial, industrial, and roadside service establishments
19and other uses of property abutting upon State highways
20including specifications for drainage and other structures
21appurtenant to such driveways. No permit shall be issued by the
22Department for the construction of any such driveway which does
23not conform to the applicable standard prescribed by the

1Department unless the application therefor is accompanied by
2drawings of and specifications for the proposed construction
3and a showing of reasonable need for departure from the
4applicable standard type of driveway prescribed by the
5Department nor unless it is made to appear that the proposed
6construction and the use thereof will not be inconsistent with
7public safety and use nor with the proper construction and
8maintenance of the highway and its drainage and other
9facilities.
10    The Department shall construct a private entrance on
11Business Route 72, west of Woods Lane, east of State Route 104,
12on the south side of the road.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
