SYNOPSIS AS INTRODUCED:

15 ILCS 20/50-23 new

Amends the State Budget Law of the Administrative Code of Illinois. Provides a continuing appropriation for the State Board of Elections regarding State and federal funds. Defines "total appropriations from all sources". Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Budget Law of the Civil Administrative Code of Illinois is amended by adding Section 50-23 as follows:

(15 ILCS 20/50-23 new)

Sec. 50-23. State Board of Elections Independent Funding Law.

(a) The Governor shall submit to the General Assembly a proposed budget for the State Board of Elections in which the total appropriations from all sources are not less than the total appropriations from all sources of the previous fiscal year.

(b) If for any reason the total appropriations from all sources are insufficient to meet the levels required by subsection (a), this Section shall constitute a continuing appropriation of all amounts necessary for those purposes. The General Assembly may appropriate lesser amounts by law.

(c) This Section shall constitute an irrevocable and continuing appropriation for the distribution of any federal funds received by the State Board of Elections for the purposes authorized by the federal government for those funds, including, but not limited to, moneys received by the Help Illinois Vote Fund. Funds appropriated under this Section shall be disbursed in accordance with any requirements imposed by the federal government, and nothing in this Section shall be construed in such a way so as to avoid any requirements imposed by the federal government in disbursing funds to the State Board of Elections. The State Treasurer and State Comptroller are hereby authorized to make distributions of federal funds as provided in this Section.

(d) For purposes of this Section, "total appropriations from all sources" includes, but is not limited to, moneys appropriated from the General Revenue Fund, the Help Illinois Vote Fund, the ERIC Operations Trust Fund, or any other fund of the State, regardless of whether the moneys appropriated from those funds are from a federal, State, public, or private source. "Total appropriations from all sources" also includes those moneys received in the Personal Property Tax Replacement Fund that are to be distributed to local election authorities.

(e) This Section may be cited as the State Board of Elections Independent Funding Law.

Section 99. Effective date. This Act takes effect upon becoming law.
