SYNOPSIS AS INTRODUCED:
 
15 ILCS 20/50-23 new

    Amends the State Budget Law of the Administrative Code of Illinois. Provides a continuing appropriation for the State Board of Elections regarding State and federal funds. Defines "total appropriations from all sources". Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Budget Law of the Civil Administrative
5Code of Illinois is amended by adding Section 50-23 as follows:
 
6    (15 ILCS 20/50-23 new)
7    Sec. 50-23. State Board of Elections Independent Funding
8Law.
9    (a) The Governor shall submit to the General Assembly a
10proposed budget for the State Board of Elections in which the
11total appropriations from all sources are not less than the
12total appropriations from all sources of the previous fiscal
13year.
14    (b) If for any reason the total appropriations from all
15sources are insufficient to meet the levels required by
16subsection (a), this Section shall constitute a continuing
17appropriation of all amounts necessary for those purposes. The
18General Assembly may appropriate lesser amounts by law.
19    (c) This Section shall constitute an irrevocable and
20continuing appropriation for the distribution of any federal
21funds received by the State Board of Elections for the purposes
22authorized by the federal government for those funds,
23including, but not limited to, moneys received by the Help

1Illinois Vote Fund. Funds appropriated under this Section shall
2be disbursed in accordance with any requirements imposed by the
3federal government, and nothing in this Section shall be
4construed in such a way so as to avoid any requirements imposed
5by the federal government in disbursing funds to the State
6Board of Elections. The State Treasurer and State Comptroller
7are hereby authorized to make distributions of federal funds as
8provided in this Section.
9    (d) For purposes of this Section, "total appropriations
10from all sources" includes, but is not limited to, moneys
11appropriated from the General Revenue Fund, the Help Illinois
12Vote Fund, the ERIC Operations Trust Fund, or any other fund of
13the State, regardless of whether the moneys appropriated from
14those funds are from a federal, State, public, or private
15source. "Total appropriations from all sources" also includes
16those moneys received in the Personal Property Tax Replacement
17Fund that are to be distributed to local election authorities.
18    (e) This Section may be cited as the State Board of
19Elections Independent Funding Law.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
