    AN ACT concerning local government.

    Be it enacted by the People of  the  State  of  Illinois,
represented in the General Assembly:

    Section  5.  The  Counties  Code  is  amended  by  adding
Section 5-1126 as follows:

    (55 ILCS 5/5-1126 new)
    Sec.  5-1126.  A county board may license or regulate any
business operating as a public accommodation that is  located
in  an  unincorporated  area  of the county, that permits the
consumption of alcoholic liquor on the business premises, and
that is not licensed under the Liquor Control  Act  of  1934.
For  purposes of this Section, "public accommodation" means a
refreshment, entertainment, or  recreation  facility  of  any
kind,   whether  licensed  or  not,  whose  goods,  services,
facilities, privileges, or advantages are extended,  offered,
sold, or otherwise made available to the public.


    Section  10.  The  Illinois  Municipal Code is amended by
adding Section 11-42-10.1 as follows:

    (65 ILCS 5/11-42-10.1 new)
    Sec.  11-42-10.1.  The  corporate  authorities  of   each
municipality  may license or regulate businesses operating as
a  public  accommodation  that  permit  the  consumption   of
alcoholic  liquor  on  the business premises and that are not
licensed under the Liquor Control Act of 1934.  For  purposes
of  this Section, "public accommodation" means a refreshment,
entertainment, or recreation facility of  any  kind,  whether
licensed   or   not,   whose   goods,  services,  facilities,
privileges, or advantages are  extended,  offered,  sold,  or
otherwise made available to the public.
    Section  99.  Effective date.  This Act takes effect upon
becoming law.
    Passed in the General Assembly April 25, 2002.
    Approved July 19, 2002.
