    AN ACT concerning emergency services.

    Be it  enacted  by  the  People  of  the  State  of  Illinois,
represented in the General Assembly:

    Section 5.  The Illinois Underground  Utility  Facilities
Damage  Prevention  Act  is amended by adding Section 11.3 as
follows:

    (220 ILCS 50/11.3 new)
    Sec.   11.3.   Emergency   telephone   system    outages;
reimbursement.    Any   person  who  negligently  damages  an
underground facility or CATS facility  causing  an  emergency
telephone  system  outage  must  reimburse  the public safety
agency that provides personnel to answer calls or to maintain
or operate an emergency telephone system  during  the  outage
for  the  agency's  costs  associated with answering calls or
maintaining or operating the system during the  outage.   For
the  purposes  of  this Section, "public safety agency" means
the same as in Section 2.02 of the Emergency Telephone System
Act.

    Section 10. The  Illinois  Vehicle  Code  is  amended  by
adding Section 7-504 as follows:

    (625 ILCS 5/7-504 new)
    Sec.   7-504.    Emergency   telephone   system  outages;
reimbursement.  Any person who  negligently  causes  a  motor
vehicle  accident  that  causes an emergency telephone system
outage must reimburse the public safety agency that  provides
personnel  to  answer  calls  or  to  maintain  or operate an
emergency telephone system during the outage for the agency's
costs associated  with  answering  calls  or  maintaining  or
operating  the system during the outage.  For the purposes of
this Section, "public safety agency" means  the  same  as  in
Section 2.02 of the Emergency Telephone System Act.
